Paraphrase: HB3037, by Rep. Preston Stinson, R-Edmond and Sen. Todd Gollihare, R-Kellyville, modifies the qualifications for persons requesting criminal arrest record expungements. It also permits a person participating in and successfully completing a diversion program for either a misdemeanor or felony offense or offenses to be immediately eligible to have the offense or offenses expunged after completion of all court-ordered program conditions and payment of all fines, fees, costs, and assessments. It requires that a person who has had a felony conviction expunged and has not been convicted of any other felony offense which has not been pardoned or expunged, have restored the right to possess any firearm or other weapon prohibited by statute, the right to apply for and carry a handgun, concealed or unconcealed, pursuant to the provisions of the Oklahoma Self-Defense Act or as otherwise permitted by law, and have the right to perform the duties of a peace officer or gunsmith, and for purposes of performing firearm repairs.

Paraphrase: SB0108, by Sen. Micheal Bergstrom, R-Adair and Rep. Ross Ford, R-Broken Arrow, makes three or more convictions related to Schedule I and Schedule II drugs, excluding marijuana, a felony punishable by imprisonment for not more than three years and by a fine not exceeding $5,000. It makes five or more convictions related to Schedule I and Schedule II drugs, excluding marijuana a felony punishable by imprisonment for not more than seven years and by a fine not exceeding $10,000. It permits an offender who is charged with certain drug possession violations and who has no prior felony convictions to be allowed to enroll in a drug addiction rehabilitation program or appear before a drug court for sentencing, at the discretion of the district attorney. It requires the criminal case against the offender to be dismissed or the sentence deferred for a period not to exceed two years upon successful completion of the drug addiction rehabilitation program or drug court program. It requires any drug addiction rehabilitation program to be approved by the district attorney and the offender, with the offender bearing all financial responsibility for the program.

Paraphrase: SB0552, by Sen. John Haste, R-Broken Arrow and Rep. Rande Worthen, R-Lawton, requires if a person charged with a crime is found to be competent that criminal proceedings be immediately resumed by setting a competency hearing within 30 business days. The bill permits treatment to restore competency to be administered in the jail or detention facility where the person is being held if the defendant is charged with a violent misdemeanor. The bill requires transportation for the defendant to be provided by the county sheriff department of the county where the person is charged. The bill requires non-violent offenders deemed to be incompetent and in need of treatment to have charges dismissed without prejudice and to be subject to civil commitment proceedings.
