1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|HOUSE BILL 1040 By: Randleman and Boles | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to school athletics; defining terms; | | directing school athletic association to establish a | 8| new category of competition; permitting certain | | schools to elect to compete in new category; | 9| specifying composition of existing category; | | prescribing frequency for category election; | 10| declaring applicability of election; providing for | | codification; and providing an effective date. | 11| | | | 12| | | | 13| | | | 14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 15| SECTION 1. NEW LAW A new section of law to be codified | | | 16|in the Oklahoma Statutes as Section 27-201 of Title 70, unless there | | | 17|is created a duplication in numbering, reads as follows: | | | 18| A. As used in this section: | | | 19| 1. "Schools of restricted enrollment" means schools that: | | | 20| a. admit students based on entrance requirements | | | 21| established by the school for admission and | | | 22| enrollment, | | | 23| | | | 24| | | | Req. 1| b. decline enrollment of students based on standards | | | 2| which differ from those established by the State | | | 3| Department of Education, | | | 4| c. control enrollment size for the maintenance of a | | | 5| maximum size standard, and | | | 6| d. use tuition or costs of attendance as factors for | | | 7| admission and enrollment; and | | | 8| 2. "Schools of unrestricted enrollment" means schools that: | | | 9| a. admit all students for enrollment and attendance who | | | 10| live within the established boundaries of the schools, | | | 11| b. may accept transfer students who are living outside | | | 12| the established boundaries of the schools, | | | 13| c. follow residency rules of the State Department of | | | 14| Education for school district residents and transfer | | | 15| students, and | | | 16| d. do not collect tuition and fees for enrollment or | | | 17| attendance. | | | 18| B. Beginning with the 2024-2025 school year, a school athletic | | | 19|association, as defined in Section 27-102 of Title 70 of the | | | 20|Oklahoma Statutes, shall establish a new category of competition for | | | 21|schools of restricted enrollment. Schools of restricted enrollment | | | 22|may elect to compete in the schools of restricted enrollment | | | 23|category by requesting a move pursuant to guidelines determined by | | | 24|the school athletic association. | | | Req. The existing alignment of classifications within the school | | | 2|athletic association shall be in a category known as schools of | | | 3|unrestricted and restricted enrollment and shall include schools of | | | 4|unrestricted enrollment and schools of restricted enrollment. | | | 5|Existing standards of enrollment size divisions for classes of | | | 6|competition established by the school athletic association shall | | | 7|remain in effect for the schools of unrestricted and restricted | | | 8|enrollment. | | | 9| D. Schools of restricted enrollment shall elect once every four | | | 10|(4) years in which category they want to compete. The election | | | 11|shall be applicable to all competitions which are governed by the | | | 12|school athletic association. | | | 13| SECTION 2.
