1| | | | 2| PROPOSED POLICY COMMITTEE SUBSTITUTE | | | 3| An Act relating to schools; creating the Student | | Retention Protocol Act of 2025; providing | 4| definitions; recommending certain screenings, | | assessments, and evaluations for students operating | 5| below a certain academic threshold; requiring parent | | or legal guardian approval for certain evaluations; | 6| allowing schools to employ qualified personnel; | | subjecting requirements to availability of funding; | 7| providing for codification; providing an effective | | date; and declaring an emergency. | 8| | | | 9| | | | 10|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 11| SECTION 1. NEW LAW A new section of law to be codified | | | 12|in the Oklahoma Statutes as Section 1210.500 of Title 70, unless | | | 13|there is created a duplication in numbering, reads as follows: | | | 14| A. This section shall be known and may be cited as the "Student | | | 15|Retention Protocol Act of 2025". | | | 16| B. As used in this act: | | | 17| 1. "At risk of being retained" means students who have been | | | 18|identified by school personnel as operating below the academic | | | 19|threshold necessary to permit enrollment into an advancing grade for | | | 20|the following school year; | | | 21| 2. "Family assessment" means a process for gathering and | | | 22|organizing information surrounding the family structure, | | | 23|composition, relationships, characteristics, interactions, and | | | 24|dynamics; | | | Req. 1| 3. "Hearing screening" means a test used to evaluate hearing | | | 2|across different pitches and determine risk for hearing loss; | | | 3| 4. "Occupational evaluation" means a test administered by an | | | 4|occupational therapist to assess areas of functioning and determine | | | 5|the need for a treatment plan or develop such a treatment plan; | | | 6| 5. "Physical therapy evaluation" means the administration, | | | 7|interpretation, and evaluation of tests and measurements of bodily | | | 8|functions and structures; | | | 9| 6. "Psychiatric evaluation" means an assessment based on | | | 10|present problems and symptoms of an individual's biological, mental, | | | 11|and social functioning which may or may not result in the diagnosis | | | 12|of a mental illness; and | | | 13| 7. "Vision screening" means the process or system used to | | | 14|identify a person having or who may be at risk of developing visual | | | 15|problems that may adversely affect their ability to learn. | | | 16| C. Students who are at risk of being retained may receive a | | | 17|hearing and visual screening and a family assessment conducted by | | | 18|qualified school personnel. Each school may employ or contract with | | | 19|qualified personnel to conduct such screenings and assessments. | | | 20| D. Students who are at risk of being retained may receive a | | | 21|psychiatric evaluation selected and completed by a qualified | | | 22|professional as determined by the State Department of Education and | | | 23|as approved by a parent or legal guardian. | | | 24| | | | Req. Students at risk of being retained may receive an | | | 2|occupational therapy or physical therapy evaluation if the screening | | | 3|and evaluations from subsections C and D of this section do not | | | 4|result in a diagnosis or recommendation for treatment and such | | | 5|evaluation is approved by a parent or legal guardian. An | | | 6|occupational therapy or physical therapy evaluation shall be | | | 7|conducted by qualified medical professionals employed by or | | | 8|contracted with the school district. | | | 9| F. The provisions of this section shall be subject to the | | | 10|availability of funding. | | | 11| SECTION 2. This act shall become effective July 1, 2025. | | | 12| SECTION 3.
