10| An Act relating to schools; amending 70 O.S. 2021, |
| Section 11-107.1, which relates to remediation |
11| courses for high school students; requiring school |
| districts to provide remediation for students who |
12| score below certain benchmarks on the ACT or SAT |
| exam; allowing certain types of remediation; |
13| authorizing State Board of Education to promulgate |
| rules; providing an effective date; and declaring an |
14| emergency. |

18|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
19| SECTION 1. AMENDATORY 70 O.S. 2021, Section 11-107.1, is |
| |
20|amended to read as follows: |
| |
21| Section 11-107.1 A. Each Beginning with the 2023-2024 school |
| |
22|year, each school district in this state may offer a shall provide |
| |
23|remediation course for high school students who score below a |
| |
24|nineteen (19) on the benchmarks on subject-area portions of the |
| |

1|American College Testing (ACT) exam or below an equivalent score |
| |
2|scores on the SAT Scholastic Aptitude Test (SAT) exam in the most |
| |
3|recent year for which student performance data is available. |
| |
4| B. Remediation required by subsection A of this section may |
| |
5|include but is not limited to: |
| |
6| 1. Extended instructional time during the school day; |
| |
7| 2. A summer academy; |
| |
8| 3. Tutoring; |
| |
9| 4. Online coursework; |
| |
10| 5. Repetition of any course in which the student has |
| |
11|demonstrated academic deficiency by scoring below the benchmarks in |
| |
12|subject-area portions of the ACT or below equivalent scores on the |
| |
13|SAT; or |
| |
14| 6. Any course designed to address areas of deficiency. |
| |
15| C. Nothing in subsection A of this section shall be construed |
| |
16|to require that a teacher providing instruction in the remediation |
| |
17|course be certified in any subject matter that is tested on the ACT |
| |
18|or SAT exam. |
| |
19| D. The State Board of Education may promulgate rules to |
| |
20|implement the provisions of this section. |
| |
21| SECTION 2. This act shall become effective July 1, 2023. |
| |
22| SECTION 3. It being immediately necessary for the preservation |
| |
23|of the public peace, health or safety, an emergency is hereby |
| |

1|declared to exist, by reason whereof this act shall take effect and |

2|be in full force from and after its passage and approval. |
