7| An Act relating to schools; amending 70 O.S. 2021, |
| Section 1210.545, which relates to Oklahoma School |
8| Testing Program annual reports; prohibiting annual |
| report from assigning grades to school sites and |
9| school districts; striking grading scale; deleting |
| exceptions; modifying indicators to include in annual |
10| report; removing grade weights; eliminating inclusion |
| of chronic absenteeism; deleting obsolete language; |
11| and providing an effective date. |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
15| SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.545, is |
| |
16|amended to read as follows: |
| |
17| Section 1210.545 A. Except as otherwise provided, as part of |
| |
18|the accountability system developed as provided for in Section |
| |
19|1210.541 of this title, the State Board of Education shall prepare |
| |
20|annual reports of the results of the Oklahoma School Testing Program |
| |
21|which describe student achievement in the state, and each school |
| |
22|site, pursuant to the Elementary and Secondary Education Act of 1965 |
| |
23|(ESEA) as reauthorized by P.L. No. 114-95, also known as the Every |
| |
24|Student Succeeds Act (ESSA), and any related federal regulations. |

1| B. The Beginning with the 2024-2025 school year, the annual |
| |
2|report as required pursuant to subsection A of this section shall |
| |
3|identify not assign school sites as having one of the following |
| |
4|grades for each indicator, separately, and by a single overview |
| |
5|grade of all indicators, defined according to rules of the State |
| |
6|Board of Education: |
| |
7| 1. "A" means schools making excellent progress; |
| |
8| 2. "B" means schools making above average progress; |
| |
9| 3. "C" means schools making satisfactory progress; |
| |
10| 4. "D" means schools making less than satisfactory progress; |
| |
11|and |
| |
12| 5. "F" means schools failing to make adequate progress or |
| |
13|school districts any grades. |
| |
14| C. Each school that has students who are tested and included in |
| |
15|the school grading system as provided for in this section shall |
| |
16|receive a school grade, except as follows: |
| |
17| 1. A school shall not receive a school grade if the number of |
| |
18|students tested and included in the school grading system is less |
| |
19|than the minimum sample size necessary for statistical reliability |
| |
20|and prevention of the unlawful release of personally identifiable |
| |
21|student data. The State Board of Education is directed to establish |
| |
22|the lowest minimum sample size necessary to meet the requirements of |
| |
23|this paragraph; and |

1| 2. The academic performance of students who are enrolled |
| |
2|full-time in an online program that is offered by a school district |
| |
3|or charter school that is not the district of residence or is not |
| |
4|located in the district of residence of the student shall be |
| |
5|reported separately by the school district or charter school and |
| |
6|shall not be included when determining the grade of the school site |
| |
7|or charter school. |
| |
8| D. The State Board of Education may adopt alternate systems of |
| |
9|accountability for statewide virtual charter schools, alternative |
| |
10|education programs as defined in Section 1210.568 of this title, and |
| |
11|schools serving only grades prekindergarten or kindergarten through |
| |
12|two. |
| |
13| E. D. The grade annual report of a school shall be based on a |
| |
14|multimeasures approach to accountability, in accordance with the |
| |
15|Elementary and Secondary Education Act of 1965 (ESEA) as |
| |
16|reauthorized by P.L. No. 114-95, also known as the Every Student |
| |
17|Succeeds Act (ESSA) and any federal regulations, that include, but |
| |
18|are not limited to, the following indicators: |
| |
19| 1. Statewide assessments, including the establishment of |
| |
20|student performance bands; |
| |
21| 2. Graduation rates for high schools; |
| |
22| 3. Statewide academic measures for elementary and middle |
| |
23|schools; |
| |
24| 4. English language proficiency for English learners; and |
| |

1| 5. At least one additional statewide measure of school quality |
| |
2|or student success, including, but not limited to, school School |
| |
3|climate, school safety, student engagement, educator engagement, |
| |
4|and/or advanced coursework and postsecondary readiness. |
| |
5| F. Of the indicators included in subsection E of this section, |
| |
6|not less than seventy percent (70%) of the overview grade must be |
| |
7|given to indicators 1, 2, 3 and 4 and, in the aggregate, with not |
| |
8|more than thirty percent (30%) of the grade given to indicator 5. |
| |
9| G. E. Further, the grade annual report of an elementary or |
| |
10|middle school site shall include, but not be limited to, a measure |
| |
11|of status for English language arts Language Arts (ELA), math and |
| |
12|science, growth in ELA and math, and English Language Proficiency |
| |
13|Assessment (ELPA) progress, and chronic absenteeism. |
| |
14| H. F. The grade annual report of a high school site shall |
| |
15|include, but not be limited to, a measure of status for English |
| |
16|language arts Language Arts (ELA), math and science status, English |
| |
17|Language Proficiency Assessment (ELPA) progress, graduation rate, |
| |
18|chronic absenteeism, and postsecondary opportunities. For purposes |
| |
19|of this section postsecondary opportunities shall include Advanced |
| |
20|Placement, International Baccalaureate, dual and concurrent |
| |
21|enrollment, internships, mentorships and apprenticeships, and |
| |
22|industry certifications. The Board shall adopt a time line for |
| |
23|moving from completion of such opportunities to crediting |
| |
24|achievement of such opportunities. |

1| I. G. The annual report shall identify the performance of each |
| |
2|school as having improved, remained the same, or declined. This |
| |
3|school improvement rating shall be based on a comparison of the |
| |
4|student and school performance data of the current year to the |
| |
5|previous year data. |
| |
6| J. H. The State Department of Education shall annually develop |
| |
7|a school site report card to be delivered to parents throughout each |
| |
8|school district. The annual report card shall be in accordance with |
| |
9|the requirements of the Elementary and Secondary Education Act of |
| |
10|1965 (ESEA), as reauthorized and amended by P.L. No. 114-95, also |
| |
11|known as the Every Student Succeeds Act (ESSA) and includes the |
| |
12|grade for the school, include information regarding school |
| |
13|improvement, an explanation of school performance, and indicators of |
| |
14|return on investment. The annual report card for each school site |
| |
15|shall be published annually by the Department on its website, and |
| |
16|every school district shall provide the school site annual report |
| |
17|card to the parent or guardian of each student enrolled in at the |
| |
18|school site. In order to provide information regarding school |
| |
19|performance for school report cards issued during the 2016-2017 and |
| |
20|2017-2018 school year, the Department shall include an explanation |
| |
21|of the changes to the statewide system of student assessments as |
| |
22|required in Section 1210.508 of this title and how the transition in |
| |
23|assessments may impact school performance. The Department shall |
| |

1|issue school report cards using the 2016-2017 school year assessment |
| |
2|data that is available. |
| |
3| K. I. The Legislature may factor in the performance of schools |
| |
4|in calculating any performance-based funding policy that is provided |
| |
5|to public school districts. |
| |
6| L. J. The State Board of Education shall promulgate rules to |
| |
7|implement the provisions of this section. |
| |
8| SECTION 2. This act shall become effective November 1, 2023. |
