1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|HOUSE BILL 2029 By: Wolfley | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to superintendents; amending 70 O.S. | | 2021, Section 5-106, which relates to boards of | 8| education contracts with superintendents; limiting | | superintendent salary for certain school districts; | 9| providing exception; updating statutory citation; | | providing an effective date; and declaring an | 10| emergency. | | | 11| | | | 12| | | | 13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 14| SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-106, is | | | 15|amended to read as follows: | | | 16| Section 5-106. A. The governing board of each school district | | | 17|in Oklahoma is hereby designated and shall hereafter be known as the | | | 18|board of education of such district. Except as otherwise provided | | | 19|in this section, the superintendent of schools appointed and | | | 20|employed by the board shall be the executive officer of the board | | | 21|and shall perform duties as the board directs. | | | 22| B. The board may contract with a superintendent for a term as | | | 23|mutually agreed upon but not to exceed three (3) years beyond the | | | 24|fiscal year in which the contract is approved by the board and | | | Req. 1|accepted by the superintendent. The contract shall include all | | | 2|other terms and conditions as agreed upon in writing by the board | | | 3|and the superintendent, subject to the provisions of subsection C of | | | 4|this section. | | | 5| C. Beginning with the 2023-2024 school year, the board of | | | 6|education of a school district with an average daily membership | | | 7|(ADM) of two hundred fifty (250) pupils or less shall not contract | | | 8|with a superintendent for a salary that is more than Eighty Thousand | | | 9|Dollars ($80,000.00) per year, including all fringe benefits, | | | 10|incentives, and extra-duty or extracurricular pay. If the | | | 11|superintendent contracts with two or more boards of education | | | 12|pursuant to subsection D of this section and the combined ADM of the | | | 13|school districts exceeds two hundred fifty (250) pupils, the | | | 14|superintendent salary limitation provided in this subsection shall | | | 15|not apply. | | | 16| D. The boards of two or more school districts may contract with | | | 17|one superintendent to serve as superintendent of the school | | | 18|districts as provided in Section45-106A of thisacttitle. | | | 19|D.E. No board of a school district having average daily | | | 20|membership (ADM) of fewer than five hundred (500) pupils shall be | | | 21|prohibited from allowing a superintendent to serve simultaneously as | | | 22|a principal. | | | 23|E.F. The chief executive officer of the board of education of | | | 24|a district in which a public developmental research school is | | | Req. 1|established shall be the director of the school appointed as | | | 2|provided in Section 1210.577 of this title. | | | 3| SECTION 2. This act shall become effective July 1, 2023. | | | 4| SECTION 3.
