1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|HOUSE BILL 2077 By: Caldwell (Chad) | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to schools; directing the State | | Department of Education to establish an online | 8| transparency portal; authorizing contracting with a | | private company to establish the portal; providing | 9| for purpose of portal; listing minimum requirements | | for the portal; requiring school district to | 10| participate in the portal; mandating materials be | | made available on the portal; authorizing rule | 11| promulgation; providing for codification; providing | | an effective date; and declaring an emergency. | 12| | | | 13| | | | 14| | | | 15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 16| SECTION 1. NEW LAW A new section of law to be codified | | | 17|in the Oklahoma Statutes as Section 11-100 of Title 70, unless there | | | 18|is created a duplication in numbering, reads as follows: | | | 19| A. The State Department of Education shall establish, or | | | 20|contract with a private company to establish, an online transparency | | | 21|portal. The portal shall be an online tool to support parental | | | 22|rights to access, review, and comment upon curriculum, instructional | | | 23|materials, textbooks, and library materials being used by the school | | | 24| | | | Req. 1|district where their child attends school, and which their child | | | 2|might be exposed to without prior parental knowledge or consent. | | | 3| B. The online transparency portal shall include, at a minimum: | | | 4| 1. A simple, universally accessible website that allows the | | | 5|user to search for, display, review, and comment on materials | | | 6|available to the user's child at the school district. Materials | | | 7|include but are not limited to: | | | 8| a. textbooks, | | | 9| b. library books, | | | 10| c. classroom instructional materials including, but not | | | 11| limited to, student activities, instructions, lesson | | | 12| plans, small group instruction, independent reading or | | | 13| viewing materials, videos, and handouts, | | | 14| d. formative and summative assessment items, | | | 15| e. supplemental instructional materials, | | | 16| f. co-curricular content and materials, especially any | | | 17| social and emotional learning or character-based | | | 18| curricula, and | | | 19| g. content from third-party learning applications; | | | 20| 2. Easy-to-use administrative interfaces for school district | | | 21|employees to upload content and for Department employees to oversee | | | 22|and have access to content; | | | 23| | | | 24| | | | Req. 1| 3. User-friendly alignment crosswalks of textbook and | | | 2|instructional content to state academic standards and other | | | 3|frameworks as needed for improved searching; | | | 4| 4. Alignment of library content to Lexile or other generally | | | 5|accepted and reputable reading levels; | | | 6| 5. International Standard Book Number (ISBN) integration of | | | 7|library materials for a robust display of library material content | | | 8|for parental review; | | | 9| 6. Content searchable by school district or publisher-supplied | | | 10|scope and sequence information; and | | | 11| 7. Public and private comment by users, with real-time | | | 12|processing of comments, reviews, and feedback. User authentication | | | 13|shall be required and comments may be cataloged and stored for | | | 14|compliance and auditing purposes. | | | 15| C. Beginning in the 2024-2025 school year, and in each | | | 16|subsequent school year, school districts shall participate in the | | | 17|online transparency portal created in subsection A of this section | | | 18|and ensure all of the materials listed in subsection B of this | | | 19|section are available on the portal for parental review. | | | 20| D. The Department may promulgate rules to implement the | | | 21|provisions of this section. | | | 22| SECTION 2. This act shall become effective July 1, 2023. | | | 23| SECTION 3. It being immediately necessary for the preservation | | | 24|of the public peace, health or safety, an emergency is hereby | | | Req.
