8| An Act relating to schools; amending 70 O.S. 2021, |
| Section 11-106.1, which relates to inspection of |
9| instructional material; requiring all material |
| purchased or made available on school property to be |
10| subject to inspection; modifying who may inspect the |
| material; providing for material which is protected |
11| by copyright law; directing inspection on school |
| property; authorizing limitation of inspection to |
12| comply with copyright laws; modifying definition of |
| instructional material; defining professional |
13| development material; providing an effective date; |
| and declaring an emergency. |

17|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
18| SECTION 1. AMENDATORY 70 O.S. 2021, Section 11-106.1, is |
| |
19|amended to read as follows: |
| |
20| Section 11-106.1 A. All material purchased by a public school |
| |
21|or made available on school property, including professional |
| |
22|development material and instructional material, including but not |
| |
23|limited to teacher manuals, films, tapes, or other supplementary |
| |
24|instructional material in any format, used by a public school as |
| |

1|part of the educational curriculum, shall be available for |
| |
2|inspection by the parents or guardians of students enrolled in the |
| |
3|school, members of the board of education of the school district, |
| |
4|members of the State Board of Education, employees of the State |
| |
5|Department of Education, and legislators. |
| |
6| B. Each school district shall develop and adopt policies |
| |
7|pertaining to the inspection of professional development material |
| |
8|and instructional materials in consultation with parents and |
| |
9|guardians material. The policies shall include procedures for |
| |
10|granting a request by a parent or guardian for reasonable access to |
| |
11|professional development material and instructional material within |
| |
12|a reasonable period of time after the request is received. If the |
| |
13|professional development material or instructional material being |
| |
14|requested is protected by copyright law, the school district shall |
| |
15|provide reasonable access for the material to be inspected on school |
| |
16|property. The school district may limit unauthorized duplication or |
| |
17|dissemination of the material in compliance with applicable |
| |
18|copyright laws. |
| |
19| C. For the purposes of this section, "instructional: |
| |
20| 1. "Instructional material" means instructional content that is |
| |
21|provided to a student, regardless of the format, including printed |
| |
22|or representational materials, library materials, audio-visual |
| |
23|materials, and materials in electronic or digital formats; and |
| |

1| 2. "Professional development material" means tools, resources, |
| |
2|and training sessions, regardless of format, for school personnel to |
| |
3|improve their teaching quality, effectiveness, and teambuilding. |
| |
4| SECTION 2. This act shall become effective July 1, 2023. |
| |
5| SECTION 3. It being immediately necessary for the preservation |
| |
6|of the public peace, health or safety, an emergency is hereby |
| |
7|declared to exist, by reason whereof this act shall take effect and |
| |
8|be in full force from and after its passage and approval. |
