7| An Act relating to schools; amending 70 O.S. 2021, |
| Section 14-106, which relates to the Oklahoma |
8| Department of Career and Technology Education |
| equipment pool; creating an exception for use of |
9| equipment pool; authorizing technology center school |
| district board of education to donate certain |
10| equipment; providing for terms of donation; |
| specifying eligible recipients of donation; and |
11| providing an effective date. |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
15| SECTION 1. AMENDATORY 70 O.S. 2021, Section 14-106, is |
| |
16|amended to read as follows: |
| |
17| Section 14-106. A. The 1. Except as provided in subsection B |
| |
18|of this section, the Oklahoma Department of Career and Technology |
| |
19|Education may operate and maintain an equipment pool, at which there |
| |
20|shall be kept equipment for the use of technology center school |
| |
21|districts and schools supported by public funds, and said department |
| |
22|the Department and schools shall be eligible for surplus property |
| |
23|and equipment. |

1| B. 2. Whenever the Department determines that any such a |
| |
2|district or school has, and does not have a need for, equipment |
| |
3|purchased wholly or partly with state or federal funds, it may, if |
| |
4|consistent with federal laws and regulations, order the equipment |
| |
5|transferred to the equipment pool; and the district or school, or |
| |
6|its officials thereof, shall thereupon have the duty to comply with |
| |
7|such the order. Provided, any equipment which has been purchased |
| |
8|wholly or in part with local school funds shall require the |
| |
9|concurrence of the governing board of that local school before the |
| |
10|equipment shall be transferred to the state equipment pool. |
| |
11| C. 3. Whenever the Department determines that a technology |
| |
12|center school district or school supported by public funds has a |
| |
13|need for any equipment in the equipment pool, the Department may |
| |
14|transfer the equipment to such district or school. |
| |
15| B. The board of education of a technology center school |
| |
16|district is authorized, in its discretion, consistent with federal |
| |
17|laws and regulations, and upon terms, conditions, and for such |
| |
18|consideration as it deems advisable, to donate obsolete, surplus, or |
| |
19|unneeded equipment, which it may have, to the board of education of |
| |
20|a school district or technology center school district in the state |
| |
21|for use in connection with any training, maintenance, or other |
| |
22|similar educational program administered by the school district or |
| |
23|technology center school district. |

1| D. C. The State Board of Career and Technology Education shall |
| |
2|adopt and enforce such rules as it deems necessary to carry out the |
| |
3|provisions of this section. |
| |
4| SECTION 2. This act shall become effective November 1, 2023. |
| |
