1| STATE OF OKLAHOMA | | | 2| 2nd Session of the 60th Legislature (2026) | | | 3|HOUSE BILL 3228 By: Humphrey | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to medical malpractice; requiring the | | State Board of Medical Licensure and Supervision to | 8| establish and maintain database of medical | | malpractice lawsuits; listing requirements for | 9| database; listing required information for database; | | requiring physicians report lawsuits within certain | 10| time; requiring Board to conduct an educational | | campaign on database; providing for codification; and | 11| providing an effective date. | | | 12| | | | 13| | | | 14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 15| SECTION 1. NEW LAW A new section of law to be codified | | | 16|in the Oklahoma Statutes as Section 481.2 of Title 59, unless there | | | 17|is created a duplication in numbering, reads as follows: | | | 18| A. The State Board of Medical Licensure and Supervision shall | | | 19|establish and maintain a comprehensive public database of medical | | | 20|malpractice lawsuits filed against licensed physicians in this | | | 21|state. The database shall: | | | 22| 1. Be user-friendly; | | | 23| 2. Be accessible to the public through the Board's official | | | 24|website; | | | Req. 1| 3. Be regularly updated; and | | | 2| 4. Comply with all applicable privacy laws concerning sensitive | | | 3|patient information. | | | 4| B. The database shall include: | | | 5| 1. The name of the physician; | | | 6| 2. The nature of the medical malpractice claim; | | | 7| 3. The date the lawsuit was filed; | | | 8| 4. The disposition of the case; | | | 9| 5. Any disciplinary action taken by the Board as a result of | | | 10|the lawsuit; and | | | 11| 6. Internet links to relevant court documents when available. | | | 12| C. All licensed physicians shall report to the Board any | | | 13|medical malpractice lawsuit filed against him or her within thirty | | | 14|(30) days of becoming aware of the lawsuit. | | | 15| D. The Board shall implement an education campaign to inform | | | 16|healthcare facilities, physicians, and the public about the database | | | 17|and the purpose of the database including, but not limited to, how | | | 18|it can be used to make informed healthcare decisions. | | | 19| SECTION 2.
