1| STATE OF OKLAHOMA | | | 2| 2nd Session of the 60th Legislature (2026) | | | 3|HOUSE BILL 3286 By: Roe | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to health insurance; defining terms; | | requiring health insurance to provide coverage for | 8| all services related to pregnancy, postpartum, and | | newborn care rendered by certain persons; requiring | 9| coverage for necessary equipment and medical | | supplies; requiring coverage for lactation | 10| consultants; requiring coverage for recommended | | breast pumps, breast pump supplies, breastfeeding | 11| supplies, and feeding aides; requiring postpartum | | services to be covered for not less than one year | 12| after birth; prohibiting cost-sharing requirements; | | clarifying what is not limited; directing Oklahoma | 13| Health Care Authority to ensure SoonerCare provides | | coverage; providing for sales and use tax exempted | 14| items; providing for codification; and providing an | | effective date. | 15| | | | 16| | | | 17|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 18| SECTION 1. NEW LAW A new section of law to be codified | | | 19|in the Oklahoma Statutes as Section 6060.60 of Title 36, unless | | | 20|there is created a duplication in numbering, reads as follows: | | | 21| A. As used in this section: | | | 22| 1. "Breast pump" means a manual or electric device designed for | | | 23|the extraction of human milk from a lactating person; | | | 24| | | | Req. "Breast pump supplies and accessories" include collection | | | 2|kits, tubing, storage bags, valves, shields, bottles, flanges, and | | | 3|other items used in conjunction with a breast pump for milk | | | 4|expression or storage; | | | 5| 3. "Certified Nurse-Midwife" means a person licensed to | | | 6|practice as an Advanced Practice Registered NurseCertified | | | 7|Nurse-Midwife (APRN-CNM) as defined in the Oklahoma Nursing Practice | | | 8|Act; | | | 9| 4. "Feeding aids" means tools or devices that assist caregivers | | | 10|in providing nutrition to infants that have difficulty | | | 11|breastfeeding, need additional supplements, or have special needs; | | | 12| 5. "Lactation consultant" means a person certified by the | | | 13|International Board of Lactation Consultant Examiners or otherwise | | | 14|credentialed under state or federal law to provide lactation support | | | 15|and counseling services; | | | 16| 6. "Licensed Certified Professional Midwife" means a person | | | 17|licensed pursuant to the Oklahoma Midwives Licensure Act; and | | | 18| 7. "Perinatal doula" means a trained, nonmedical professional | | | 19|who provides continuous physical, emotional, and informational | | | 20|support to a person before, during, and after childbirth, or | | | 21|miscarriage. | | | 22| B. Required Coverage. | | | 23| 1. Every individual and group health insurance policy, | | | 24|contract, or plan delivered, issued for delivery, renewed, extended, | | | Req. 1|or modified in this state shall provide coverage for all services | | | 2|related to pregnancy, postpartum, and newborn care that are rendered | | | 3|by: | | | 4| a. a perinatal doula, or | | | 5| b. an Advanced Practice Registered NurseCertified | | | 6| Nurse-Midwife (APRN-CNM) or Licensed Certified | | | 7| Professional Midwife, including services for home | | | 8| births, home visits, and support during labor, or | | | 9| miscarriage. | | | 10| 2. Required coverage shall include all necessary equipment and | | | 11|medical supplies for home birth and postpartum recovery. | | | 12| 3. Coverage shall include home visits by a lactation consultant | | | 13|for assessment, counseling, and support. | | | 14| 4. Coverage shall include the purchase, rental, or replacement | | | 15|of breast pumps, breast pump supplies, breastfeeding supplies, and | | | 16|feeding aides as recommended by a lactation consultant or health | | | 17|care provider. | | | 18| 5. Coverage for postpartum services shall be available for not | | | 19|less than one (1) year following birth. | | | 20| 6. Coverage required under this section shall be provided | | | 21|without any cost-sharing requirement, including deductibles, | | | 22|copayments, or coinsurance. | | | 23| 7. Nothing in this section shall limit the number of lactation | | | 24|consultations, home visits, breast pumps, breast pump supplies, | | | Req. 1|breastfeeding supplies, or feeding aides that a beneficiary is | | | 2|entitled to receive. | | | 3| C. Medical Assistance Program. | | | 4| 1. The Oklahoma Health Care Authority shall ensure that the | | | 5|state's medical assistance program, SoonerCare, provides coverage | | | 6|consistent with paragraphs 2 through 7 of subsection B of this | | | 7|section. | | | 8| 2. Such coverage shall include consultant-recommended or | | | 9|provider-recommended breast pumps and related supplies without | | | 10|limitation on quantity or frequency of services. | | | 11| SECTION 2. NEW LAW A new section of law to be codified | | | 12|in the Oklahoma Statutes as Section 1378 of Title 68, unless there | | | 13|is created a duplication in numbering, reads as follows: | | | 14| A. The gross receipts or gross proceeds derived from the sale, | | | 15|rental, or lease of breast pumps, breast pump supplies, | | | 16|breastfeeding supplies, and feeding aides shall be exempt from the | | | 17|sales tax and the use tax levied pursuant to the Oklahoma Sales Tax | | | 18|Code and the Oklahoma Use Tax Code. | | | 19| B. For purposes of this section, "breast pump", "breast pump | | | 20|supplies", and "feeding aides" shall have the same meanings as | | | 21|provided in Section 1 of this act. | | | 22| SECTION 3.
