1| PROPOSED OVERSIGHT COMMITTEE SUBSTITUTE | | | 2| An Act relating to education; requiring public | | schools to provide annual instruction to students on | 3| firearm safety; requiring the Council on Law | | Enforcement Education and Training to consult with | 4| the Department of Education; mandating the | | development or approval of an appropriate program; | 5| requiring certain topics to be taught to certain | | grades; prohibiting certain viewpoints and live | 6| firearm rounds; requiring opt out option; allowing | | schools to begin instruction earlier if appropriate; | 7| providing an effective date; and declaring an | | emergency. | 8| | | | 9| | | | 10|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 11| SECTION 1. NEW LAW A new section of law to be codified | | | 12|in the Oklahoma Statutes as Section 11-103.6q of Title 70, unless | | | 13|there is created a duplication in numbering, reads as follows: | | | 14| A. Beginning with the 2026-2027 school year, every public | | | 15|school in this state shall annually provide students with | | | 16|age-appropriate and grade-appropriate instruction on firearm safety. | | | 17| The Council on Law Enforcement Education and Training (CLEET), in | | | 18|consultation with the Department of Education, shall determine the | | | 19|earliest appropriate age and grade for which firearm safety | | | 20|instruction shall be required. In determining the earliest | | | 21|appropriate grade for instruction on firearm safety, the Department | | | 22|shall study all relevant data and risk factors, including the | | | 23|earliest age at which incidents of injury involving firearms are | | | 24|reported and the earliest age at which children are susceptible to | | | Req. 1|harm from found firearms. For purposes of this section, public | | | 2|schools shall include charter schools and virtual charter schools. | | | 3| B. 1. The Council on Law Enforcement Education and Training, | | | 4|in consultation with the Department of Education, shall develop or | | | 5|approve a curriculum or program of instruction on firearm safety. | | | 6|The departments shall not approve curricula or programs of | | | 7|instruction if the curricula, programs of instruction, or any | | | 8|materials used as part of the curricula or programs of instruction | | | 9|bear a brand or organizational affiliation. Notwithstanding the | | | 10|provisions of this subsection, curricula, programs of instruction, | | | 11|or any of the instructional materials used to educate students on | | | 12|firearm safety in accordance with this section may bear a brand | | | 13|issued by the State of Oklahoma or by any state department, agency, | | | 14|or division. | | | 15| 2. The instruction required under subsection A of this section | | | 16|may be provided in a classroom setting, through the viewing of a | | | 17|video, or through the review of online resources or materials, as | | | 18|determined by the Department of Education. | | | 19| 3. Each school shall determine how best to incorporate the | | | 20|instruction required under subsection A of this section into the | | | 21|school year. Instruction by a CLEET-certified school resource | | | 22|officer, or local member of law enforcement currently certified by | | | 23|CLEET, shall be considered best practice. | | | 24| | | | Req. 1| C. The instruction required under subsection A of this section | | | 2|shall be age-appropriate. | | | 3| 1. Kindergarten through fifth grade students shall be taught | | | 4|basic firearm safety including, but not limited to: | | | 5| a. stop, | | | 6| b. do not touch, | | | 7| c. leave the area, and | | | 8| d. tell an adult; | | | 9| 2. Students in grades six through twelve shall be provided | | | 10|instruction on best practices and guidelines for safe handling and | | | 11|storage of a firearm to prevent accidents and ensure safety. Such | | | 12|instruction shall include, but not be limited to, teaching students: | | | 13| a. safe storage of firearms, | | | 14| b. school safety relating to firearms, | | | 15| c. how to avoid injury if the student finds a firearm, | | | 16| d. to never touch a found firearm, and | | | 17| e. to immediately notify an adult of the location of a | | | 18| found firearm; | | | 19| 3. All instruction shall be viewpoint neutral on political | | | 20|topics such as gun rights and gun violence; and | | | 21| 4. Instruction shall not include the use or presence of live | | | 22|ammunition, live fire, or live firearms. | | | 23| D. Before providing firearm safety instruction to students, | | | 24|each school shall notify parents and legal guardians of the required | | | Req. 1|instruction and include an option with details on how to opt their | | | 2|student out of said instruction. A school may provide an | | | 3|alternative educational activity to a student whose parent or legal | | | 4|guardian has opted them out of the firearm safety instruction. | | | 5| E. Each public school shall begin firearm instruction at the | | | 6|required grade level determined by CLEET in accordance with | | | 7|subsection A of this section. A public school may elect to begin | | | 8|age-appropriate firearm instruction earlier than the required grade | | | 9|level if appropriate for its school district. | | | 10| SECTION 2. This act shall become effective July 1, 2026. | | | 11| SECTION 3.
