 8|       An Act relating to Home and Community-based programs;           |
  |       directing the Department of Human Services to update            |
 9|       and maintain certain website; requiring Department to           |
  |       include a rating system, inspection reports,                    |
10|       substantiated complaints, and administrator                     |
  |       information; mandating annual updates from agencies;            |
11|       providing for codification; and providing an                    |
  |       effective date.                                                 |

15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
16|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
17|in the Oklahoma Statutes as Section 1-1975 of Title 63, unless there   |
  |                                                                       |
18|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
19|    A.  The Department of Human Services shall update and maintain     |
  |                                                                       |
20|its Provider Search website that locates agencies that provide         |
  |                                                                       |
21|services for the following Home and Community-based programs:          |
  |                                                                       |
22|    1.  Advantage Waiver;                                              |
  |                                                                       |
23|    2.  Living Choice;                                                 |
  |                                                                       |
24|    3.  Medically Fragile Waiver; and                                  |
  |                                                                       |

 1|    4.  State Plan Personal Care (SPPC).                               |
  |                                                                       |
 2|    B.  The website shall also include:                                |
  |                                                                       |
 3|    1.  A rating system established by the Department or another       |
  |                                                                       |
 4|accredited licensing agency;                                           |
  |                                                                       |
 5|    2.  Inspection reports;                                            |
  |                                                                       |
 6|    3.  Substantiated complaints;                                      |
  |                                                                       |
 7|    4.  Administrator information; and                                 |
  |                                                                       |
 8|    5.  A link to the State Department of Health to be able to         |
  |                                                                       |
 9|report an issue with an agency.                                        |
  |                                                                       |
10|    C.  The Department shall require agencies to update information    |
  |                                                                       |
11|on the website annually.                                               |
  |                                                                       |
12|    SECTION 2.  This act shall become effective November 1, 2026.      |
