1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|HOUSE JOINT | |RESOLUTION 1002 By: Talley | 4| | | | 5| | | | 6| | | AS INTRODUCED | 7| | | A Joint Resolution directing the Secretary of State | 8| to refer to the people for their approval or | | rejection a proposed amendment to Section 23 of | 9| Article V of the Oklahoma Constitution; allowing a | | member of the Legislature to be employed as a | 10| certified teacher with a public school district in | | this state after completion of certain term; making | 11| language gender neutral; providing ballot title; and | | directing filing. | 12| | | | 13| | | | 14|BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE | | | 15|1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE: | | | 16| SECTION 1. The Secretary of State shall refer to the people for | | | 17|their approval or rejection, as and in the manner provided by law, | | | 18|the following proposed amendment to Section 23 of Article V of the | | | 19|Constitution of the State of Oklahoma to read as follows: | | | 20| Section 23.NoA. Except as provided for in subsection B of | | | 21|this section, no member of the Legislature shall, during the term | | | 22|for which he or she was elected, be appointed or elected to any | | | 23|office or commission in the State, which shall have been created, or | | | 24|the emoluments of which shall have been increased, during his or her | | | Req. 1|term of office, nor shall any member receive any appointment from | | | 2|the Governor, the Governor and Senate, or from the Legislature, | | | 3|during the term for which he or she shall have been elected, nor | | | 4|shall any member, during the term for which he or she shall have | | | 5|been elected, or within two years thereafter, be interested, | | | 6|directly or indirectly, in any contract with the State, or any | | | 7|county or other subdivision thereof, authorized by law passed during | | | 8|the term for which he or she shall have been elected. | | | 9| B. The provisions of this section shall not prohibit a member | | | 10|of the Legislature from being employed as a certified teacher by a | | | 11|public school district in this state after completing the term to | | | 12|which he or she was elected. | | | 13| SECTION 2. The Ballot Title for the proposed Constitutional | | | 14|amendment as set forth in SECTION 1 of this resolution shall be in | | | 15|the following form: | | | 16| BALLOT TITLE | | | 17|Legislative Referendum No. ____ State Question No. ____ | | | 18|THE GIST OF THE PROPOSITION IS AS FOLLOWS: | | | 19| This measure amends Section 23 of Article 5 of the Oklahoma | | | 20| Constitution.
