1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 1031 By: Jett | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to schools; requiring certain schools | | that administer certain survey to include certain | 8| affidavit; defining term; requiring third parties | | that administer certain survey to include certain | 9| affidavit; providing for codification; providing an | | effective date; and declaring an emergency. | 10| | | | 11| | | | 12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 13| SECTION 1. NEW LAW A new section of law to be codified | | | 14|in the Oklahoma Statutes as Section 24-160 of Title 70, unless there | | | 15|is created a duplication in numbering, reads as follows: | | | 16| A. Beginning in the 2023-2024 school year, a school district, | | | 17|public charter school, or virtual charter school that administers | | | 18|any survey shall include as part of the survey an affidavit | | | 19|verifying that administration of the survey and the collection of | | | 20|survey responses complies with the Protection of Pupil Rights | | | 21|Amendment, 20 U.S.C. Section 1232h. For the purposes of this | | | 22|section, "survey" means any questionnaire, data collection, risk | | | 23|assessment, or solicitation of information from students used to | | | 24|assess home environment, political or philosophical ideology, | | | Req. 1|religion, political affiliation, information about families, gender | | | 2|orientation, sexual orientation, safety or risk, drug use, or health | | | 3|including vaccination status. "Survey" does not mean an academic | | | 4|assessment. | | | 5| B. If a school district, public charter school, or virtual | | | 6|charter school contracts with a third party to administer a survey | | | 7|and collect survey responses, the third party shall include the | | | 8|affidavit required by subsection A of this section. | | | 9| SECTION 2. This act shall become effective July 1, 2023. | | | 10| SECTION 3.
