 7|       An Act relating to central purchasing; defining                 |
  |       terms; prohibiting contracts without certain                    |
 8|       verification; mandating punishment for certain                  |
  |       violations; authorizing the Attorney General to have            |
 9|       certain responsibility; providing for codification;             |
  |       and providing an effective date.                                |

12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
13|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
14|in the Oklahoma Statutes as Section 85.44F of Title 74, unless there   |
  |                                                                       |
15|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
16|    A.  As used in this act:                                           |
  |                                                                       |
17|    1.  "Economic boycott" means without an ordinary business          |
  |                                                                       |
18|purpose, refusing to deal with, terminating business activities        |
  |                                                                       |
19|with, or otherwise taking any commercial action that is intended to    |
  |                                                                       |
20|penalize, inflict economic harm on, limit commercial relations with,   |
  |                                                                       |
21|or change or limit the activities of a company because the company,    |
  |                                                                       |
22|without violating controlling federal or state law:                    |
  |                                                                       |
23|                                                                       |
  |                                                                       |
24|                                                                       |

 1|          a.   engages in the exploration, production, utilization,    |
  |                                                                       |
 2|               transportation, sale, or manufacturing of fossil        |
  |                                                                       |
 3|               fuel-based energy, timber, mining, or agriculture,      |
  |                                                                       |
 4|          b.   engages in, facilitates, or supports the manufacture,   |
  |                                                                       |
 5|               import, distribution, marketing or advertising, sale,   |
  |                                                                       |
 6|               or lawful use of firearms, ammunition or components     |
  |                                                                       |
 7|               parts and accessories of firearms or ammunition, or     |
  |                                                                       |
 8|          c.   does not meet, is not expected to meet, or does not     |
  |                                                                       |
 9|               commit to meet environmental standards or disclosure    |
  |                                                                       |
10|               criteria, in particular to eliminate, reduce, offset,   |
  |                                                                       |
11|               or disclose greenhouse gas emissions.                   |
  |                                                                       |
12|    B.  No state agency or political subdivision shall enter into      |
  |                                                                       |
13|agreements or contracts with a business without written verification   |
  |                                                                       |
14|that the business does not engage in economic boycotts and will not    |
  |                                                                       |
15|engage in economic boycotts during the term of the agreement or        |
  |                                                                       |
16|contract.  Any business that violates this act shall be obligated to   |
  |                                                                       |
17|pay damages to the state in an amount three times the amount of the    |
  |                                                                       |
18|agreement or contract.                                                 |
  |                                                                       |
19|    C.  The Office of the Attorney General shall have the ability to   |
  |                                                                       |
20|enforce the provisions of this act.                                    |
  |                                                                       |
21|    SECTION 2.  This act shall become effective November 1, 2023.      |
  |                                                                       |
