1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 107 By: Bergstrom | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to state government; defining terms; | | prohibiting contracts with certain countries; | 8| allowing the Governor to make certain designations; | | requiring the Governor to consult with certain | 9| offices for assessment; providing for codification; | | and providing an effective date. | 10| | | | 11| | | | 12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 13| SECTION 1. NEW LAW A new section of law to be codified | | | 14|in the Oklahoma Statutes as Section 90.9 of Title 74, unless there | | | 15|is created a duplication in numbering, reads as follows: | | | 16| A. As used in this section: | | | 17| 1. "Company" means a sole proprietorship, organization, | | | 18|association, corporation, partnership, joint venture, limited | | | 19|partnership, limited liability partnership, or limited liability | | | 20|company, including a wholly owned subsidiary, majority-owned | | | 21|subsidiary, parent company, or affiliate of those entities or | | | 22|business associations, that exists to make a profit; | | | 23| | | | 24| | | | Req. "Critical infrastructure" means a communication | | | 2|infrastructure system, cybersecurity system, electric grid, | | | 3|hazardous waste treatment system, or water treatment facility; | | | 4| 3. "Cybersecurity" means the measures taken to protect a | | | 5|computer, computer network, computer system, or other | | | 6|technology-based infrastructure against unauthorized used or access; | | | 7| 4. "Designated country" means a country designated by the | | | 8|Governor as a threat to critical infrastructure; and | | | 9| 5. "Public utility" or "utility" shall have the same meaning as | | | 10|defined in Section 250 of Title 17 of the Oklahoma Statutes. | | | 11| B. No state agency or political subdivision of this state shall | | | 12|enter into a contract or agreement with any company that is directly | | | 13|influenced or owned by a designated country, that is related to | | | 14|critical infrastructure and that would grant the company access or | | | 15|control of critical infrastructure, cybersecurity networks, or | | | 16|public utilities. | | | 17| C. The Governor may designate countries as threats to critical | | | 18|infrastructure. The Governor shall first consult with the | | | 19|Commissioner of Public Safety and the Director of the Oklahoma | | | 20|Office of Homeland Security for assessments of threats to critical | | | 21|infrastructure. | | | 22| SECTION 2.
