11|       An Act relating to the Opioid Overdose Fatality                 |
  |       Review Board; amending 63 O.S. 2021, Section 2-1002,            |
12|       which relates to composition and meetings of the                |
  |       Board; modifying membership of the Board; modifying             |
13|       required frequency of meetings; providing an                    |
  |       effective date; and declaring an emergency.                     |

16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
17|    SECTION 1.     AMENDATORY     63 O.S. 2021, Section 2-1002, is     |
  |                                                                       |
18|amended to read as follows:                                            |
  |                                                                       |
19|    Section 2-1002.  A.  The Opioid Overdose Fatality Review Board     |
  |                                                                       |
20|shall be composed of twenty-two (22) eighteen (18) members, or their   |
  |                                                                       |
21|designees, as follows:                                                 |
  |                                                                       |
22|    1.  Twelve Eight of the members shall be:                          |
  |                                                                       |
23|         a.    the Attorney General or designee,                       |
  |                                                                       |
24|         b.    the Chief Medical Examiner or designee,                 |
  |                                                                       |

 1|         c.    the State Commissioner of Health or designee,           |
  |                                                                       |
 2|         d.    the Chief of Injury Prevention Services of the State    |
  |                                                                       |
 3|              Department of Health or designee,                        |
  |                                                                       |
 4|         e.    the President of the Oklahoma State Medical             |
  |                                                                       |
 5|              Association or designee,                                 |
  |                                                                       |
 6|         f.    the Director of the Oklahoma State Bureau of            |
  |                                                                       |
 7|              Narcotics and Dangerous Drugs Control or designee,       |
  |                                                                       |
 8|         g.                                                            |
  |                                                                       |
 9|         d.    the Commissioner of the Department of Mental Health     |
  |                                                                       |
10|              and Substance Abuse Services or designee,                |
  |                                                                       |
11|         h.    the President of the Oklahoma Osteopathic Association   |
  |                                                                       |
12|              or designee,                                             |
  |                                                                       |
13|         i.                                                            |
  |                                                                       |
14|         e.    the Director of the Department of Human Services or     |
  |                                                                       |
15|              designee,                                                |
  |                                                                       |
16|         j.                                                            |
  |                                                                       |
17|         f.    the Director of the Oklahoma State Bureau of            |
  |                                                                       |
18|              Investigation or designee,                               |
  |                                                                       |
19|         k.                                                            |
  |                                                                       |
20|         g.    the President of the Association of Oklahoma Narcotic   |
  |                                                                       |
21|              Enforcers or designee, and                               |
  |                                                                       |
22|         l.                                                            |
  |                                                                       |
23|         h.    the Executive Director of the State Board of Pharmacy   |
  |                                                                       |

 1|    2.  Ten of the members shall be appointed by the Attorney          |
  |                                                                       |
 2|General, shall serve for terms of two (2) years and shall be           |
  |                                                                       |
 3|eligible for reappointment.  The members shall be persons having       |
  |                                                                       |
 4|training and experience in matters related to opioid abuse and         |
  |                                                                       |
 5|prevention.  The appointed members shall include:                      |
  |                                                                       |
 6|         a.    a county sheriff selected from a list of three names    |
  |                                                                       |
 7|              submitted by the executive board of the Oklahoma         |
  |                                                                       |
 8|              Sheriffs' Association,                                   |
  |                                                                       |
 9|         b.    a chief of a municipal police department selected       |
  |                                                                       |
10|              from a list of three names submitted by the Oklahoma     |
  |                                                                       |
11|              Association of Chiefs of Police,                         |
  |                                                                       |
12|         c.    an attorney licensed in this state who is in private    |
  |                                                                       |
13|              practice selected from a list of three names submitted   |
  |                                                                       |
14|              by the Board of Governors of the Oklahoma Bar            |
  |                                                                       |
15|              Association,                                             |
  |                                                                       |
16|         d.    a district attorney selected from a list of three       |
  |                                                                       |
17|              names submitted by the District Attorneys Council,       |
  |                                                                       |
18|         e.    a physician with emergency medical training selected    |
  |                                                                       |
19|              from a list of three names submitted by the Oklahoma     |
  |                                                                       |
20|              State Medical Association,                               |
  |                                                                       |
21|         f.    a physician with experience in drug addiction           |
  |                                                                       |
22|              treatment and recovery selected from a list of three     |
  |                                                                       |
23|              names submitted by the Oklahoma Osteopathic              |
  |                                                                       |
24|              Association,                                             |

 1|         g.    a nurse selected from a list of three names submitted   |
  |                                                                       |
 2|              by the Oklahoma Nurses Association,                      |
  |                                                                       |
 3|         h.    two individuals, at least one of whom shall be a        |
  |                                                                       |
 4|              person who currently receives or formerly has been a     |
  |                                                                       |
 5|              consumer of addiction recovery services related to       |
  |                                                                       |
 6|              opioid use, selected from a list of three names          |
  |                                                                       |
 7|              submitted by the Department of Mental Health and         |
  |                                                                       |
 8|              Substance Abuse Services, and                            |
  |                                                                       |
 9|         i.    a member of the judiciary selected from a list of       |
  |                                                                       |
10|              three names submitted by the Oklahoma Supreme Court.     |
  |                                                                       |
11|    B.  Every two (2) years the Board shall elect from among its       |
  |                                                                       |
12|membership a chair and a vice-chair vice chair.  The Board shall       |
  |                                                                       |
13|meet at least quarterly and may meet more as frequently as necessary   |
  |                                                                       |
14|as determined by the chair.  Members shall serve without               |
  |                                                                       |
15|compensation but may be reimbursed for necessary travel out of funds   |
  |                                                                       |
16|available to the Office of the Attorney General and the Department     |
  |                                                                       |
17|of Mental Health and Substance Abuse Services pursuant to the State    |
  |                                                                       |
18|Travel Reimbursement Act; provided, that the reimbursement shall be    |
  |                                                                       |
19|paid, in the case of state employee members, by the agency employing   |
  |                                                                       |
20|the member.                                                            |
  |                                                                       |
21|    C.  With funds appropriated or otherwise available for that        |
  |                                                                       |
22|purpose, the Office of the Attorney General, jointly with the          |
  |                                                                       |
23|Department of Mental Health and Substance Abuse Services, shall        |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|provide administrative assistance and services to the Opioid           |
  |                                                                       |
 2|Overdose Fatality Review Board.                                        |
  |                                                                       |
 3|    SECTION 2.  This act shall become effective July 1, 2024.          |
  |                                                                       |
 4|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
 5|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
 6|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
 7|be in full force from and after its passage and approval.              |
