1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 148 By: Hicks | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to special education; directing each | | school district to create a special education | 8| advisory council; providing for membership; requiring | | certain portion of council to be certain parents or | 9| legal guardians; requiring appointments by certain | | date; providing for election of chair and vice chair; | 10| requiring meeting to be called by certain date; | | providing for staff support; subjecting meetings to | 11| certain act; providing duties of the council; | | providing for codification; providing an effective | 12| date; and declaring an emergency. | | | 13| | | | 14| | | | 15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 16| SECTION 1. NEW LAW A new section of law to be codified | | | 17|in the Oklahoma Statutes as Section 13-117 of Title 70, unless there | | | 18|is created a duplication in numbering, reads as follows: | | | 19| A. For the purpose of increasing involvement of parents and | | | 20|legal guardians of students with disabilities in school district | | | 21|board of education policy making and decision making, each school | | | 22|district shall create a special education advisory council. The | | | 23|council shall consist of at least three (3) but no more than eleven | | | 24|(11) members. The board of education shall appoint all members, at | | | Req. 1|least one-half of whom shall be parents or legal guardians of | | | 2|students with disabilities. Members shall be appointed no later | | | 3|than September 15 of each school year for two-year terms. At the | | | 4|first meeting, the council shall elect a chair and vice chair. | | | 5| B. A meeting of the special education advisory council shall be | | | 6|called by the school district superintendent no later than October 1 | | | 7|of each year for the purpose of addressing special education issues. | | | 8| The council may meet at other times as necessary in a meeting space | | | 9|furnished by the district. The district shall provide staff support | | | 10|for the council. All council meetings shall be subject to the | | | 11|Oklahoma Open Meeting Act. | | | 12| C. The duties of the special education advisory council shall | | | 13|be to assist in the formulation of district goals for students with | | | 14|disabilities, to advise the school district on matters relating to | | | 15|continuous program improvement efforts as they pertain to special | | | 16|education, and to provide community-wide support to families with | | | 17|students in the district's special education programs. | | | 18| SECTION 2. This act shall become effective July 1, 2023. | | | 19| SECTION 3.
