6| An Act relating to school district salary schedules; |
| amending 70 O.S. 2021, Section 5-141, which relates |
7| to district adoption of minimum salary schedules; |
| requiring the schedules to include certain salary and |
8| benefit information; updating statutory references; |
| providing an effective date; and declaring an |
9| emergency. |

12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
13| SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-141, is |
| |
14|amended to read as follows: |
| |
15| Section 5-141. A. Each school district of this state shall |
| |
16|adopt a minimum salary schedule, as provided for in subsection B of |
| |
17|this section, and shall transmit a copy of it to the State Board of |
| |
18|Education within thirty (30) days after adoption. A school district |
| |
19|shall not calculate salaries of teachers solely as a proportion of |
| |
20|the salaries of the administrators of the district. |
| |
21| B. The minimum salary schedule adopted and transmitted to the |
| |
22|State Board of Education pursuant to this section shall include: |
| |

1| 1. The base salary amounts including the minimum state salary |
| |
2|amounts provided for in Section 18-114.14 of this title and district |
| |
3|increments in excess of the minimums; and |
| |
4| 2. District-paid benefits, such as life, dental, disability, |
| |
5|salary protection, vision, cancer, and health supplemental |
| |
6|insurance. |
| |
7| C. Districts shall be encouraged to provide compensation |
| |
8|schedules to reflect district policies and circumstances, including |
| |
9|differential pay for different subject areas and special incentives |
| |
10|for teachers in districts with specific geographical attributes. |
| |
11|Districts may also adopt a salary schedule that provides additional |
| |
12|compensation for achieving certain ratings under the Oklahoma |
| |
13|Teacher and Leader Effectiveness Evaluation System (TLE) as set |
| |
14|forth in Section 6 of this act 6-101.16 of this title. Any salary |
| |
15|schedule adopted by a district pursuant to this section shall not |
| |
16|set salaries at amounts less than those set pursuant to Section |
| |
17|18-114.12 18-114.14 of this title. |
| |
18| C. D. The State Department of Education shall compile a report |
| |
19|of the minimum salary schedules for every school district in the |
| |
20|state and shall submit the report to the Governor, Speaker of the |
| |
21|House of Representatives, and President Pro Tempore of the Senate no |
| |
22|later than December 15 of each year. |
| |
23| D. E. Each school district shall file within fifteen (15) days |
| |
24|of signing the contract, the employment contract of the |
| |

1|superintendent of the school district with the State Department of |
| |
2|Education. The Department shall keep all contracts available for |
| |
3|inspection by the public. The school district shall not be |
| |
4|authorized to pay any salary, benefits, or other compensation to a |
| |
5|superintendent which are not specified in the contract on file and |
| |
6|shall not pay administrators any amounts for accumulated sick leave |
| |
7|that are not calculated on the same formula used for determining |
| |
8|payment for accumulated sick leave benefits for other full-time |
| |
9|employees of that school district and shall not pay administrators |
| |
10|any amounts for accumulated vacation leave benefits that are not |
| |
11|calculated on the same formula used for determining payment for |
| |
12|accumulated vacation leave benefits for other twelve-month full-time |
| |
13|employees of that school district. |
| |
14| E. F. By October 1 of each year each district board of |
| |
15|education shall prepare a schedule of salaries and fringe benefits |
| |
16|paid administrators employed by the district, including a |
| |
17|description of the fringe benefits. The schedule shall be a public |
| |
18|record and shall be disclosed as required by the Oklahoma Open |
| |
19|Records Act. The board shall file a copy of the schedule with the |
| |
20|State Department of Education within one week of completion. |
| |
21| F. G. For purposes of this section the term "administrator" |
| |
22|shall include employees who are employed and certified as |
| |
23|superintendents, assistant superintendents, principals, and |
| |

1|assistant principals and who have responsibilities for supervising |
| |
2|classroom teachers. |
| |
3| SECTION 2. This act shall become effective July 1, 2023. |
| |
4| SECTION 3. It being immediately necessary for the preservation |
| |
5|of the public peace, health, or safety, an emergency is hereby |
| |
6|declared to exist, by reason whereof this act shall take effect and |
| |
7|be in full force from and after its passage and approval. |
