 7|       An Act relating to the state Medicaid program;                  |
  |       prohibiting the Oklahoma Health Care Authority from             |
 8|       imposing certain requirements on providers; directing           |
  |       promulgation of rules; providing for codification;              |
 9|       and declaring an emergency.                                     |
  |                                                                       |

11|                                                                       |
  |                                                                       |
12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
13|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
14|in the Oklahoma Statutes as Section 5072 of Title 63, unless there     |
  |                                                                       |
15|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
16|    A.  The Oklahoma Health Care Authority shall not require, as a     |
  |                                                                       |
17|condition of participation in the state Medicaid program, a provider   |
  |                                                                       |
18|to submit an attestation or other document disclosing whether the      |
  |                                                                       |
19|provider performs, refers for, or is affiliated with any entity that   |
  |                                                                       |
20|performs abortions including, but not limited to, by requiring such    |
  |                                                                       |
21|attestation or document as a condition of:                             |
  |                                                                       |
22|    1.  Contracting with the Authority or any contracted entity for    |
  |                                                                       |
23|Medicaid services;                                                     |
  |                                                                       |
24|    2.  Receiving payment for Medicaid services; or                    |
  |                                                                       |

 1|    3.  Receiving any credentialing necessary for Medicaid             |
  |                                                                       |
 2|providers.                                                             |
  |                                                                       |
 3|    B.  The Oklahoma Health Care Authority Board shall promulgate      |
  |                                                                       |
 4|rules to implement the provisions of this section.                     |
  |                                                                       |
 5|    SECTION 2.  It being immediately necessary for the preservation    |
  |                                                                       |
 6|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
 7|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
 8|be in full force from and after its passage and approval.              |
