 7|       An Act relating to schools; directing the State Board           |
  |       of Education to establish certain pilot program to              |
 8|       provide grants for certain purpose; providing for use           |
  |       of grants; directing the Board to establish certain             |
 9|       criteria for awarding grants; providing for grant               |
  |       application; requiring school districts with certain            |
10|       average daily membership to be included in pilot                |
  |       program; requiring pilot program grant recipients to            |
11|       submit certain report; providing for contents of                |
  |       report; providing for codification; providing an                |
12|       effective date; and declaring an emergency.                     |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
15|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
16|in the Oklahoma Statutes as Section 1-126 of Title 70, unless there    |
  |                                                                       |
17|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
18|    A.  The State Board of Education shall establish a two-year        |
  |                                                                       |
19|pilot program to provide grants to public school districts to          |
  |                                                                       |
20|provide child care for children of school district employees.  A       |
  |                                                                       |
21|grant may be used to:                                                  |
  |                                                                       |
22|    1.  Establish an on-site child care facility licensed pursuant     |
  |                                                                       |
23|to the Oklahoma Child Care Facilities Licensing Act for children of    |
  |                                                                       |

  |                                                                       |

 1|school district employees that is located on school district           |
  |                                                                       |
 2|property;                                                              |
  |                                                                       |
 3|    2.  Contract with a child care facility licensed pursuant to the   |
  |                                                                       |
 4|Oklahoma Child Care Facilities Licensing Act to provide child care     |
  |                                                                       |
 5|for school district employees; or                                      |
  |                                                                       |
 6|    3.  Provide school district employees with stipends to help        |
  |                                                                       |
 7|cover a portion of child care-related expenses for children of         |
  |                                                                       |
 8|school district employees.                                             |
  |                                                                       |
 9|    B.  The State Board of Education shall establish criteria for      |
  |                                                                       |
10|awarding grants which shall include but not be limited to the          |
  |                                                                       |
11|following factors:                                                     |
  |                                                                       |
12|    1.  The availability of licensed child care facilities in the      |
  |                                                                       |
13|school district; and                                                   |
  |                                                                       |
14|    2.  The need for child care resources among school district        |
  |                                                                       |
15|employees.                                                             |
  |                                                                       |
16|    C.  A public school district seeking to participate in the pilot   |
  |                                                                       |
17|program shall apply to the State Board of Education for a grant in     |
  |                                                                       |
18|the manner and on a form prescribed by the Board.                      |
  |                                                                       |
19|    D.  The State Board of Education shall ensure that pilot program   |
  |                                                                       |
20|grants are given to a representative sample of Oklahoma school         |
  |                                                                       |
21|districts, which shall include:                                        |
  |                                                                       |
22|    1.  A school district with an average daily membership (ADM) of    |
  |                                                                       |
23|more than two thousand five hundred (2,500) students but less than     |
  |                                                                       |
24|ten thousand (10,000) students;                                        |
  |                                                                       |

 1|    2.  A school district with an ADM of two thousand five hundred     |
  |                                                                       |
 2|(2,500) students or less; and                                          |
  |                                                                       |
 3|    3.  A school district with an ADM of one thousand (1,000)          |
  |                                                                       |
 4|students or less.                                                      |
  |                                                                       |
 5|    E.  Two (2) years after implementation of the pilot program,       |
  |                                                                       |
 6|school districts that receive pilot program grants pursuant to this    |
  |                                                                       |
 7|section shall provide a report to the State Board of Education that    |
  |                                                                       |
 8|includes an itemized accounting of how grant funds were spent, an      |
  |                                                                       |
 9|evaluation of the program by school district employees who were        |
  |                                                                       |
10|provided child care through the grant program, and recommendations,    |
  |                                                                       |
11|if any, for future program operations.                                 |
  |                                                                       |
12|    SECTION 2.  This act shall become effective July 1, 2023.          |
  |                                                                       |
13|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
14|of the public peace, health, or safety, an emergency is hereby         |
  |                                                                       |
15|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
16|be in full force from and after its passage and approval.              |
