1| STATE OF OKLAHOMA | | | 2| 2nd Session of the 60th Legislature (2026) | | | 3|SENATE BILL 1836 By: Kirt | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to health care providers; requiring | | certain health care providers to provide specified | 8| mental health screening instrument during certain | | patient visits; directing promulgation of certain | 9| rules and creation of certain educational materials; | | providing for codification; and providing an | 10| effective date. | | | 11| | | | 12| | | | 13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 14| SECTION 1. NEW LAW A new section of law to be codified | | | 15|in the Oklahoma Statutes as Section 510.2 of Title 59, unless there | | | 16|is created a duplication in numbering, reads as follows: | | | 17| A. A physician shall provide an evidence-based, validated | | | 18|mental health screening instrument as prescribed by the State Board | | | 19|of Medical Licensure and Supervision to each patient during or | | | 20|before a routine primary care visit at least once annually. This | | | 21|requirement shall not apply to physicians who do not practice direct | | | 22|client care. | | | 23| B. The Board shall promulgate rules pertaining to the required | | | 24|screening instrument and shall create such information and | | | Req. 1|educational materials necessary to implement the provisions of this | | | 2|section. The Board may collaborate with the State Board of | | | 3|Osteopathic Examiners and the Oklahoma Board of Nursing to develop | | | 4|such rules, information, and educational materials. | | | 5| SECTION 2. NEW LAW A new section of law to be codified | | | 6|in the Oklahoma Statutes as Section 519.13 of Title 59, unless there | | | 7|is created a duplication in numbering, reads as follows: | | | 8| A. A physician assistant shall provide an evidence-based, | | | 9|validated mental health screening instrument as prescribed by the | | | 10|State Board of Medical Licensure and Supervision to each patient | | | 11|during or before a routine primary care visit at least once | | | 12|annually. This requirement shall not apply to physician assistants | | | 13|who do not practice direct client care. | | | 14| B. The Board shall promulgate rules pertaining to the required | | | 15|screening instrument and shall create such information and | | | 16|educational materials necessary to implement the provisions of this | | | 17|section. The Board may collaborate with the State Board of | | | 18|Osteopathic Examiners and the Oklahoma Board of Nursing to develop | | | 19|such rules, information, and educational materials. | | | 20| SECTION 3. This | | | 3|requirement shall not apply to Advanced Practice Registered Nurses | | | 4|who do not practice direct client care. | | | 5| B. The Board shall promulgate rules pertaining to the required | | | 6|screening instrument and shall create such information and | | | 7|educational materials necessary to implement the provisions of this | | | 8|section. The Board may collaborate with the State Board of Medical | | | 9|Licensure and Supervision and the State Board of Osteopathic | | | 10|Examiners to develop such rules, information, and educational | | | 11|materials. | | | 12| SECTION 4. An osteopathic physician shall provide an evidence-based, | | | 16|validated mental health screening instrument as prescribed by the | | | 17|State Board of Osteopathic Examiners to each patient during or | | | 18|before a routine primary care visit at least once annually. This | | | 19|requirement shall not apply to osteopathic physicians who do not | | | 20|practice direct client care. | | | 21| B. The Board shall promulgate rules pertaining to the required | | | 22|screening instrument and shall create such information and | | | 23|educational materials necessary to implement the provisions of this | | | 24|section.
