1|ENGROSSED SENATE | |BILL NO. 194 By: Murdock and Kirt of the | 2| Senate | | | 3| and | | | 4| Newton of the House | | | 5| | | | 6| An Act relating to the Commissioners of the Land | | Office; amending 64 O.S. 2021, Section 1005, which | 7| relates to appointment of the Secretary of the Land | | Office; requiring appointment to be subject to the | 8| advice and consent of the Senate; providing an | | effective date; and declaring an emergency. | 9| | | | 10| | | | 11|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 12| SECTION 1. AMENDATORY 64 O.S. 2021, Section 1005, is | | | 13|amended to read as follows: | | | 14| Section 1005. A. The Land Office shall be administered by the | | | 15|Secretary of the Land Office under the supervision of the | | | 16|Commissioners of the Land Office. The Secretary shall, subject to | | | 17|the qualifications listed in subsection B of this section, be | | | 18|appointed by the Governor with the advice and consent of the | | | 19|Commissioners of the Land Office and the advice and consent of the | | | 20|Senate. It shall be the duty of the Secretary to execute, under the | | | 21|supervision of the Commissioners of the Land Office, the provisions | | | 22|of the Enabling Act of Oklahoma as it relates to the management of | | | 23|school lands and other public lands, the Constitution of the State | | | 24|of Oklahoma, and all laws, regulations, and duties pertaining to the | | | Page 1 ___________________________________________________________________________
1|Commissioners of the Land Office and to carry into execution the | | | 2|will of the Commissioners of the Land Office not in conflict with | | | 3|any law. | | | 4| B. The Secretary of the Land Office shall: | | | 5| 1. Possess an advanced degree from an accredited college or | | | 6|university; | | | 7| 2. Have not less than five (5) years of experience in | | | 8|government, law or finance; and | | | 9| 3. Meet other specific requirements as specified by the | | | 10|Commissioners of the Land Office. | | | 11| C. The Secretary of the Land Office shall serve a four-year | | | 12|term of service concurrent with the term of the appointing Governor | | | 13|and the other elected officials on the Commission. The Secretary | | | 14|may serve consecutive terms and may serve past the term of the | | | 15|appointing Governor only until a successor is appointed. If the | | | 16|appointment is terminated or if the Secretary resigns, becomes | | | 17|incapacitated or for any reason is unable to perform the duties of | | | 18|the Secretary, the Commissioners may appoint an acting Secretary | | | 19|until a replacement may be appointed to complete the term as | | | 20|provided for in this section. | | | 21| SECTION 2. This act shall become effective July 1, 2023. | | | 22| SECTION 3.
