 7|       An Act relating to school support personnel;                    |
  |       directing school districts to receive certain amount            |
 8|       of funds; directing each school district board of               |
  |       education to determine how to distribute funds to               |
 9|       school support personnel; prohibiting certain changes           |
  |       in hours of support personnel; providing for                    |
10|       noncodification; providing an effective date; and               |
  |       declaring an emergency.                                         |

13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
14|    SECTION 1.     NEW LAW     A new section of law not to be          |
  |                                                                       |
15|codified in the Oklahoma Statutes reads as follows:                    |
  |                                                                       |
16|    A.  Beginning with the 2023-2024 school year, each school          |
  |                                                                       |
17|district shall receive an amount equivalent to One Thousand Two        |
  |                                                                       |
18|Hundred Dollars ($1,200.00) for each member of the district's          |
  |                                                                       |
19|support personnel, as defined by Section 26-103 of Title 70 of the     |
  |                                                                       |
20|Oklahoma Statutes.                                                     |
  |                                                                       |
21|    B.  Each school district board of education shall decide whether   |
  |                                                                       |
22|to distribute the funds received pursuant to subsection A of this      |
  |                                                                       |
23|section to:                                                            |

 1|    1.  Provide a one-time pay increase equal to One Thousand Two      |
  |                                                                       |
 2|Hundred Dollars ($1,200.00) to each member of the district's support   |
  |                                                                       |
 3|personnel; or                                                          |
  |                                                                       |
 4|    2.  Provide a one-time pay increase to members of the district's   |
  |                                                                       |
 5|support personnel in an amount to be determined by the school          |
  |                                                                       |
 6|district board of education based on employee performance or on the    |
  |                                                                       |
 7|need to retain employees in high-demand positions.                     |
  |                                                                       |
 8|    C.  A school district shall not lower the hours of any support     |
  |                                                                       |
 9|personnel for the purpose of preventing qualification for or to        |
  |                                                                       |
10|offset the increase in compensation required by this section.  A       |
  |                                                                       |
11|school district shall not require any support personnel to work more   |
  |                                                                       |
12|than the hours required to qualify as full-time support personnel,     |
  |                                                                       |
13|as provided for by Section 26-103 of Title 70 of the Oklahoma          |
  |                                                                       |
14|Statutes, to be eligible for the increase in compensation required     |
  |                                                                       |
15|by this section.                                                       |
  |                                                                       |
16|    SECTION 2.  This act shall become effective July 1, 2023.          |
  |                                                                       |
17|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
18|of the public peace, health, or safety, an emergency is hereby         |
  |                                                                       |
19|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
20|be in full force from and after its passage and approval.              |
