 7|       An Act relating to schools; directing certain school            |
  |       districts to receive certain grant beginning in                 |
 8|       certain school year subject to availability of                  |
  |       funding; defining term; exempting districts that                |
 9|       receive grants from certain penalties; directing                |
  |       applications for grants to be submitted to the State            |
10|       Department of Education; providing for distribution             |
  |       of grants if funds are insufficient to provide grants           |
11|       to all applicants; providing for promulgation of                |
  |       rules; providing for codification; providing an                 |
12|       effective date; and declaring an emergency.                     |

15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
16|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
17|in the Oklahoma Statutes as Section 18-113.6 of Title 70, unless       |
  |                                                                       |
18|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
19|    A.  Subject to the availability of funding, beginning with the     |
  |                                                                       |
20|2023-2024 school year, if the number of students enrolled in a         |
  |                                                                       |
21|single grade level in a school district exceeds the class size         |
  |                                                                       |
22|limits set forth in Section 18-113.1, 18-113.2, or 18-113.3 of Title   |
  |                                                                       |
23|70 of the Oklahoma Statutes, the school district shall receive a       |
  |                                                                       |
24|grant to employ a teacher's assistant in an amount equal to the        |
  |                                                                       |

 1|average salary of a teacher's assistant, as determined by the State    |
  |                                                                       |
 2|Department of Education.  For the purposes of this section,            |
  |                                                                       |
 3|"teacher's assistant" shall have the same meaning as provided for in   |
  |                                                                       |
 4|Section 6-127 of Title 70 of the Oklahoma Statutes.                    |
  |                                                                       |
 5|    B.  A school district that receives a grant pursuant to this       |
  |                                                                       |
 6|section shall not be subject to the penalties for exceeding the        |
  |                                                                       |
 7|class size limits set forth in Section 18-113.1, 18-113.2, or          |
  |                                                                       |
 8|18-113.3 of Title 70 of the Oklahoma Statutes.                         |
  |                                                                       |
 9|    C.  Application for a grant authorized by subsection A of this     |
  |                                                                       |
10|section shall be submitted to the State Department of Education on a   |
  |                                                                       |
11|form and in a manner prescribed by the Department.  If funds are       |
  |                                                                       |
12|insufficient to provide grants to all eligible applicants, available   |
  |                                                                       |
13|funds shall be distributed on a pro rata basis.                        |
  |                                                                       |
14|    D.  The State Board of Education shall promulgate rules to         |
  |                                                                       |
15|implement the provisions of this section.                              |
  |                                                                       |
16|    SECTION 2.  This act shall become effective July 1, 2023.          |
  |                                                                       |
17|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
18|of the public peace, health, or safety, an emergency is hereby         |
  |                                                                       |
19|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
20|be in full force from and after its passage and approval.              |
