1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 279 By: Dahm | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to parental rights; creating the | | Parental Rights Immunization Act; providing short | 8| title; requiring health care provider to obtain | | informed consent from legal representative prior to | 9| vaccinating child; requiring health care provider to | | provide certain information; providing for | 10| codification; and providing an effective date. | | | 11| | | | 12| | | | 13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 14| SECTION 1. NEW LAW A new section of law to be codified | | | 15|in the Oklahoma Statutes as Section 2006 of Title 25, unless there | | | 16|is created a duplication in numbering, reads as follows: | | | 17| A. This section shall be known and may be cited as the | | | 18|"Parental Rights Immunization Act". | | | 19| B. Each health care provider who administers a vaccine set | | | 20|forth in the Vaccine Injury Table, as established by the United | | | 21|States Department of Health and Human Services, shall obtain | | | 22|informed consent from the legal representative or other adult | | | 23|authorized by law to consent on behalf of a minor to whom such | | | 24|provider intends to administer such vaccine. 1|the vaccine, the health care provider shall provide relevant | | | 2|information regarding benefits and risks of the vaccine as well as | | | 3|information concerning the National Vaccine Injury Compensation | | | 4|Program. | | | 5| C. Providing a copy of the Vaccine Information Statement, the | | | 6|source of which is clearly identified, and making available for | | | 7|review the Centers for Disease Control and Prevention's | | | 8|"Epidemiology and Prevention of Vaccine-Preventable Diseases: | | | 9|Vaccine Excipient and Media Summary", the Centers for Disease | | | 10|Control and Prevention's Vaccine Injury Table or the Centers for | | | 11|Disease Control and Prevention's contraindications and precautions | | | 12|or any combination of these three resources to the legal | | | 13|representative or other adult authorized by law to consent on behalf | | | 14|of a minor shall constitute a minimum standard of relevant | | | 15|information. | | | 16| SECTION 2.
