 7|       An Act relating to state government; prohibiting                |
  |       certain officials from using certain public service             |
 8|       announcements and advertisements; providing                     |
  |       exceptions; providing for codification; and providing           |
 9|       an effective date.                                              |

  |                                                                       |
11|                                                                       |
  |                                                                       |
12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
13|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
14|in the Oklahoma Statutes as Section 4263 of Title 74, unless there     |
  |                                                                       |
15|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
16|    A.  Except as provided by subsection B of this section, no         |
  |                                                                       |
17|elected official within three (3) months prior to an election in       |
  |                                                                       |
18|which the elected official's name will appear on the ballot shall      |
  |                                                                       |
19|use or allow to be used such official's name, image, likeness, or      |
  |                                                                       |
20|voice in a public service announcement or in an advertisement or       |
  |                                                                       |
21|other promotional message created or purchased using public funds.     |
  |                                                                       |
22|    B.  Nothing in this section shall apply during a declared state    |
  |                                                                       |
23|disaster or emergency.  For purposes of this section a "declared       |
  |                                                                       |
24|state disaster or emergency" means an event:                           |

 1|    1.  For which a Governor's state of emergency proclamation has     |
  |                                                                       |
 2|been issued;                                                           |
  |                                                                       |
 3|    2.  For which a Presidential Major Disaster or Emergency           |
  |                                                                       |
 4|Declaration has been issued; or                                        |
  |                                                                       |
 5|    3.  Such as another disaster or emergency event within the state   |
  |                                                                       |
 6|for which a good-faith response effort is required and for which       |
  |                                                                       |
 7|another authorized official of the state designates such event as a    |
  |                                                                       |
 8|disaster or emergency.                                                 |
  |                                                                       |
 9|    SECTION 2.  This act shall become effective November 1, 2023.      |
