6| An Act relating to higher education; amending 70 O.S. |
| 2021, Section 3207.1, which relates to transfer of |
7| credits; modifying language regarding submission of |
| certain report; stating legislative intent that |
8| certain institutions of higher education not require |
| a score higher than certain recommended score on |
9| certain examination to grant certain course credit; |
| allowing certain institution president to make |
10| certain determination; requiring institutions to post |
| certain policy on campus websites; providing an |
11| effective date; and declaring an emergency. |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
15| SECTION 1. AMENDATORY 70 O.S. 2021, Section 3207.1, is |
| |
16|amended to read as follows: |
| |
17| Section 3207.1. A. It is the intent of the Legislature that |
| |
18|credits earned by students in any institution of higher education |
| |
19|within The Oklahoma State System of Higher Education be fully |
| |
20|accepted at any other institution of higher education within The |
| |
21|Oklahoma State System of Higher Education and that the Oklahoma |
| |
22|State Regents for Higher Education assume leadership in working with |
| |
23|institutional faculty and administrators to ensure that students |
| |
24|move smoothly from one level of education to another. Objectives |

1|should include development of transfer policies and guides, degree |
| |
2|sheets, course equivalencies, and common course numbering. |
| |
3| B. It is the intent of the Legislature that institutions of |
| |
4|higher education within The Oklahoma State System of Higher |
| |
5|Education, private institutions accredited by the Oklahoma State |
| |
6|Regents for Higher Education, technology center school districts, |
| |
7|schools or training programs licensed, accredited, approved, or |
| |
8|regulated by any state agency, and private schools licensed by the |
| |
9|Oklahoma Board of Private Vocational Schools be prohibited from |
| |
10|placing statements in documents or brochures given to students or |
| |
11|advertising in publications that credits earned at the institution, |
| |
12|training program, or school are fully accepted at another |
| |
13|institution or school without having a written agreement with the |
| |
14|other institution or school stating that the credits will be fully |
| |
15|accepted. |
| |
16| C. It is the intent of the Legislature that in establishing the |
| |
17|minimum required score on an Advanced Placement Examination for |
| |
18|granting course credit for a particular lower division course, |
| |
19|institutions of higher education within The Oklahoma State System of |
| |
20|Higher Education shall not require an Advanced Placement Exam score |
| |
21|of more than three, except the requirement of an Advanced Placement |
| |
22|Exam score of more than three shall be permitted for granting |
| |
23|additional course credit for a lower division course or courses |
| |
24|sequenced with the initial lower division course. Credit policy |

1|regarding all Advanced Placement Exams shall be posted on campus |
| |
2|websites effective for the 2021-22 fall academic term and for each |
| |
3|academic term thereafter. The institutions of higher education |
| |
4|within The Oklahoma State System of Higher Education shall conduct |
| |
5|biennial reviews of their Advanced Placement credit policy. The |
| |
6|Oklahoma State System of Higher Education shall report noncompliance |
| |
7|to the House Common Education Committee, House Higher Education and |
| |
8|Career Tech Committee, and Senate Education Committee, or similarly |
| |
9|named House Committee if the named Committees no longer exist, |
| |
10|education committees in the Senate and House of Representatives by |
| |
11|December 1 each year beginning December 1, 2021. |
| |
12| D. It is the intent of the Legislature that in establishing the |
| |
13|minimum required score on a College-Level Examination Program (CLEP) |
| |
14|examination for granting course credit for a particular lower |
| |
15|division course, institutions of higher education within The |
| |
16|Oklahoma State System of Higher Education shall not require a score |
| |
17|higher than the minimum score recommended by a nonprofit higher |
| |
18|education association that makes recommendations on college-level |
| |
19|equivalencies. Provided, however, the president of the institution |
| |
20|may determine, based on evidence, that a higher score on the |
| |
21|examination is necessary to indicate that a student is sufficiently |
| |
22|prepared to be successful in a related, more advanced course for |
| |
23|which the lower division course is a prerequisite. Institutions |
| |
24|shall post on campus websites their CLEP examination policy |

1|effective for the 2023-2024 academic year and for each academic year |
| |
2|thereafter. |
| |
3| SECTION 2. This act shall become effective July 1, 2023. |
| |
4| SECTION 3. It being immediately necessary for the preservation |
| |
5|of the public peace, health, or safety, an emergency is hereby |
| |
6|declared to exist, by reason whereof this act shall take effect and |
| |
7|be in full force from and after its passage and approval. |
