1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 40 By: Bullard | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to teacher pay; creating a task force | | to study and make recommendations regarding certain | 8| types of pay to reward the highest-quality teachers; | | providing expiration date; providing for membership; | 9| providing for designation of chair and vice chair; | | requiring appointments by certain date; requiring | 10| organizational meeting by certain date; specifying | | quorum; providing for frequency of meetings; allowing | 11| members to participate via videoconference; | | prohibiting compensation or travel reimbursement for | 12| members; providing for staff support; requiring | | submission of certain report by certain date; | 13| providing for codification; providing an effective | | date; and declaring an emergency. | 14| | | | 15| | | | 16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 17| SECTION 1. NEW LAW A new section of law to be codified | | | 18|in the Oklahoma Statutes as Section 18-126 of Title 70, unless there | | | 19|is created a duplication in numbering, reads as follows: | | | 20| A. There is hereby created until November 30, 2024, a task | | | 21|force to study and make recommendations for pay for performance, | | | 22|qualitative pay, and/or merit pay that would reward the | | | 23|highest-quality teachers in this state and could be used to recruit | | | 24|and retain high-quality teachers. | | | Req. 1| B. The task force shall be comprised of ten (10) members to be | | | 2|appointed as follows: | | | 3| 1. Two members appointed by the President Pro Tempore of the | | | 4|Senate, one of whom shall be a teacher employed by a public school | | | 5|district located in a county with a population of less than seventy | | | 6|thousand (70,000) according to the latest Federal Decennial Census | | | 7|and one of whom shall be a teacher employed by a public school | | | 8|district located in a county with a population of more than seventy | | | 9|thousand (70,000) according to the latest Federal Decennial Census; | | | 10| 2. Two members appointed by the Speaker of the House of | | | 11|Representatives, one of whom shall be a teacher employed by a public | | | 12|school district located in a county with a population of less than | | | 13|seventy thousand (70,000) according to the latest Federal Decennial | | | 14|Census and one of whom shall be a teacher employed by a public | | | 15|school district located in a county with a population of more than | | | 16|seventy thousand (70,000) according to the latest Federal Decennial | | | 17|Census; | | | 18| 3. One member appointed by the Governor, who shall be a teacher | | | 19|employed by a public school district in this state; | | | 20| 4. One member appointed by the Superintendent of Public | | | 21|Instruction, who shall be a current or former Oklahoma Teacher of | | | 22|the Year and who shall serve as chair of the task force; | | | 23| 5. One member appointed by the President Pro Tempore of the | | | 24|Senate, who shall be a superintendent employed by a public school | | | Req. 1|district in this state and who shall serve as vice chair of the task | | | 2|force; | | | 3| 6. One member appointed by the Speaker of the House of | | | 4|Representatives, who shall be a superintendent employed by a public | | | 5|school district in this state; | | | 6| 7. One member appointed by the Governor, who shall be a current | | | 7|business owner in this state who is not employed by or contracted | | | 8|with a public school district in this state; and | | | 9| 8. One member appointed by the Chancellor of The Oklahoma State | | | 10|System of Higher Education, who shall be a member of the Oklahoma | | | 11|Association of Colleges for Teacher Education. | | | 12| C. Appointments to the task force shall be made within thirty | | | 13|(30) days after the effective date of this act. The task force | | | 14|shall conduct an organizational meeting not later than September 1, | | | 15|2023. | | | 16| D. A quorum of the task force shall be required to approve any | | | 17|final action of the task force. For purposes of this section, five | | | 18|members shall constitute a quorum. | | | 19| E. The task force may meet as often as may be required to | | | 20|perform the duties imposed upon it. | | | 21| F. Task force members may participate via videoconference if | | | 22|they are visible and audible to each other through a video monitor. | | | 23| G. Members of the task force shall receive no compensation or | | | 24|travel reimbursement. | | | Req. No. 33 Page 3 ___________________________________________________________________________
1| H. The State Department of Education shall provide staff and | | | 2|administrative support for the task force. | | | 3| I. The task force shall submit a report of its findings and | | | 4|recommendations by November 30, 2024, to the chairs of the Senate | | | 5|and House of Representatives education committees. | | | 6| SECTION 2. This act shall become effective July 1, 2023. | | | 7| SECTION 3.
