7| An Act relating to health care; amending 59 O.S. |
| 2021, Section 650, which relates to interventional |
8| pain management; modifying, adding, and deleting |
| definitions; authorizing Certified Registered Nurse |
9| Anesthetist to provide certain services and operate |
| certain facilities under specified conditions; |
10| providing certain construction; updating statutory |
| reference; updating statutory language; and providing |
11| an effective date. |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
15| SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is |
| |
16|amended to read as follows: |
| |
17| Section 650. A. This act section shall be known and may be |
| |
18|cited as the "Oklahoma Interventional Pain Management and Treatment |
| |
19|Act". |
| |
20| B. As used in this section: |
| |
21| 1. "Chronic pain" means a pain state which is subacute, |
| |
22|persistent and intractable; |
| |
23| 2. "Fluoroscope" means a radiologic instrument equipped with a |
| |
24|fluorescent screen on which opaque internal structures can be viewed |
| |

1|as moving shadow images formed by the differential transmission of |
| |
2|X-rays throughout the body "Fluoroscopy" means a medical imaging |
| |
3|procedure that uses an X-ray beam to take real-time footage of |
| |
4|moving internal body parts such as bones, muscles, joints, organs, |
| |
5|and tissue to display a consistent radiographic picture |
| |
6|progressively onto a screen; and |
| |
7| 3. "Interventional pain management" means the practice of |
| |
8|medicine delivery of health care services devoted to the diagnosis |
| |
9|and treatment of chronic pain, through the use of such techniques |
| |
10|as: |
| |
11| a. ablation of targeted nerves, |
| |
12| b. percutaneous precision needle placement within the |
| |
13| spinal column with placement of drugs such as local |
| |
14| anesthetics, steroids, and analgesics in targeted |
| |
15| areas of the spinal column, or |
| |
16| c. surgical techniques, such as laser or endoscopic |
| |
17| diskectomy discectomy, intrathecal infusion pumps and |
| |
18| spinal cord stimulators, or |
| |
19| d. fluoroscopy. |
| |
20| C. It shall be unlawful to practice or offer to practice |
| |
21|interventional pain management in this state unless such person has: |
| |
22| 1. Has been duly licensed under the provisions of the Oklahoma |
| |
23|Allopathic Medical and Surgical Licensure and Supervision Act or the |
| |
24|Oklahoma Osteopathic Medicine Act; or |

1| 2. Is a Certified Registered Nurse Anesthetist licensed in |
| |
2|accordance with the Oklahoma Nursing Practice Act who holds a valid |
| |
3|certification in Nonsurgical Pain Management from the National Board |
| |
4|of Certification and Recertification for Nurse Anesthetists and |
| |
5|practices in accordance with the certification. |
| |
6| D. Nothing in this section shall be construed to forbid the |
| |
7|administration of lumbar intra-laminar epidural steroid injections |
| |
8|or peripheral nerve blocks by a certified registered nurse |
| |
9|anesthetist when requested to do so by a physician and under the |
| |
10|supervision of A Certified Registered Nurse Anesthetist who meets |
| |
11|the criteria of subsection C of this section may: |
| |
12| 1. Practice interventional pain management, except for surgical |
| |
13|techniques, in collaboration with an allopathic or osteopathic |
| |
14|physician licensed in this state and under conditions in which |
| |
15|timely on-site consultation by such allopathic or osteopathic |
| |
16|physician is available. |
| |
17| E. A certified registered nurse anesthetist shall not operate; |
| |
18| 2. Operate a freestanding pain management facility without |
| |
19|direct supervision of a in collaboration with an allopathic or |
| |
20|osteopathic physician who is board-certified in interventional pain |
| |
21|management or its equivalent; and |
| |
22| 3. Perform procedural sedation. |
| |
23| E. Nothing in this section shall authorize a Certified |
| |
24|Registered Nurse Anesthetist to prescribe or dispense any opioid or |
| |

1|any other controlled dangerous substance to be taken by the patient |
| |
2|offsite for the management of chronic pain. |
| |
3| SECTION 2. This act shall become effective November 1, 2025. |
