7| An Act relating to students; amending 70 O.S. 2021, |
| Section 11-107.1, which relates to remediation |
8| courses for high school students; requiring rather |
| than allowing school districts to provide remediation |
9| courses for students who score below certain |
| benchmarks on certain exams; allowing certain types |
10| of remediation; providing for promulgation of rules; |
| providing an effective date; and declaring an |
11| emergency. |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
15| SECTION 1. AMENDATORY 70 O.S. 2021, Section 11-107.1, is |
| |
16|amended to read as follows: |
| |
17| Section 11-107.1. A. Each Beginning with the 2023-2024 school |
| |
18|year, each school district in this state may offer a shall provide |
| |
19|remediation course courses for high school students who score below |
| |
20|a nineteen (19) on the benchmarks on subject-area portions of the |
| |
21|American College Testing (ACT) exam or below an equivalent score |
| |
22|scores on the SAT exam in the most recent year for which student |
| |
23|performance data is available. |

1| B. Remediation required by subsection A of this section may |
| |
2|include but is not limited to: |
| |
3| 1. Extended instructional time during the school day; |
| |
4| 2. A summer academy; |
| |
5| 3. Tutoring; |
| |
6| 4. Online coursework; |
| |
7| 5. Repetition of any course in which the student has |
| |
8|demonstrated academic deficiency by scoring below the benchmarks on |
| |
9|subject-area portions of the ACT or SAT; or |
| |
10| 6. Other supplementary services. |
| |
11| C. Nothing in subsection A of this section shall be construed |
| |
12|to require that a teacher providing instruction in the remediation |
| |
13|course be certified in any subject matter that is tested on the ACT |
| |
14|or SAT exam. |
| |
15| D. The State Board of Education may promulgate rules to |
| |
16|implement the provisions of this section. |
| |
17| SECTION 2. This act shall become effective July 1, 2023. |
| |
18| SECTION 3. It being immediately necessary for the preservation |
| |
19|of the public peace, health or safety, an emergency is hereby |
| |
20|declared to exist, by reason whereof this act shall take effect and |
| |
21|be in full force from and after its passage and approval. |
