 7|       An Act relating to public finance; authorizing the              |
  |       Legislature to transfer certain federal funds to                |
 8|       other states for certain purposes; providing                    |
  |       procedure for transfer; prohibiting certain transfers           |
 9|       at certain times; requiring the Director of the                 |
  |       Office of Management and Enterprise Services to take            |
10|       certain actions; requiring the Office of Management             |
  |       and Enterprise Services to promulgate rules;                    |
11|       providing for codification; and declaring an                    |
  |       emergency.                                                      |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
15|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
16|in the Oklahoma Statutes as Section 34.502 of Title 62, unless there   |
  |                                                                       |
17|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
18|    A.  Notwithstanding any other provision of state or federal law,   |
  |                                                                       |
19|the Oklahoma Legislature may transfer all or part of any federal       |
  |                                                                       |
20|funds which have been awarded to the state in response to the          |
  |                                                                       |
21|COVID-19 pandemic to one or more states along the southern United      |
  |                                                                       |
22|States border with Mexico to support additional border security        |
  |                                                                       |
23|activities including, but not limited to, completing construction of   |
  |                                                                       |
24|the border wall.                                                       |

 1|    B.  By adoption of a joint resolution, the Legislature shall       |
  |                                                                       |
 2|specify the amount of funds to be transferred and which state or       |
  |                                                                       |
 3|states shall receive the transferred funds.  Any funds received by     |
  |                                                                       |
 4|the state as described in subsection A of this section while the       |
  |                                                                       |
 5|Legislature is not in session shall not be transferred or expended     |
  |                                                                       |
 6|unless such transfer or expenditure has been authorized by a joint     |
  |                                                                       |
 7|resolution in the previous session or until the enactment of a joint   |
  |                                                                       |
 8|resolution in the next session.                                        |
  |                                                                       |
 9|    C.  The Director of the Office of Management and Enterprise        |
  |                                                                       |
10|Services shall work with the appropriate officials in the receiving    |
  |                                                                       |
11|state or states to effectuate the transfer of funds as directed in     |
  |                                                                       |
12|the joint resolution.                                                  |
  |                                                                       |
13|    D.  The Director of the Office of Management and Enterprise        |
  |                                                                       |
14|Services shall promulgate rules and establish procedures to            |
  |                                                                       |
15|implement the provisions of this act.                                  |
  |                                                                       |
16|    SECTION 2.  It being immediately necessary for the preservation    |
  |                                                                       |
17|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
18|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
19|be in full force from and after its passage and approval.              |
