8| An Act relating to schools; creating the Rewarding |
| Student Outcomes Act; providing short title; |
9| providing purpose; defining terms; directing the |
| Superintendent of Public Instruction beginning in |
10| certain school year to determine and inform certain |
| schools of certain average percentage; directing the |
11| Superintendent beginning in certain school year to |
| determine and inform certain schools of certain |
12| minimum number of graduates in certain cohorts; |
| establishing qualifications for bonuses; providing |
13| bonus amounts; amending 70 O.S. 2021, Section |
| 1210.545, which relates to annual accountability |
14| reports; updating statutory language; replacing |
| certain factor to be used in calculating certain |
15| school site grades; providing for measurement of |
| postsecondary opportunities for high school sites; |
16| providing for codification; and providing an |
| effective date. |

20|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
21| SECTION 1. NEW LAW A new section of law to be codified |
| |
22|in the Oklahoma Statutes as Section 18-202.2 of Title 70, unless |
| |
23|there is created a duplication in numbering, reads as follows: |

1| A. This act shall be known and may be cited as the "Rewarding |
| |
2|Student Outcomes Act". The purpose of the act shall be to create an |
| |
3|outcomes-based career, college, and military readiness incentive |
| |
4|program for school districts, charter schools, and virtual charter |
| |
5|schools in this state. |
| |
6| B. As used in this act: |
| |
7| 1. "Career readiness" means a graduating senior who: |
| |
8| a. scores the silver level or above on the ACT WorkKeys |
| |
9| assessment, or |
| |
10| b. earns an industry credential |
| |
11|during a time period established by the Superintendent of Public |
| |
12|Instruction; |
| |
13| 2. "College readiness" means a graduating senior who: |
| |
14| a. achieves a benchmark score on the ACT, SAT, or |
| |
15| another assessment designated by the State Department |
| |
16| of Education, |
| |
17| b. scores a 3, 4, or 5 on an Advanced Placement |
| |
18| examination, |
| |
19| c. scores a 4, 5, 6, or 7 on an International |
| |
20| Baccalaureate examination, or |
| |
21| d. earns transcripted college credit while still in high |
| |
22| school through concurrent or dual enrollment |
| |
23|during a time period established by the Superintendent of Public |
| |
24|Instruction; |

1| 3. "Economically disadvantaged" shall have the same meaning as |
| |
2|provided for in Section 18-109.5 of Title 70 of the Oklahoma |
| |
3|Statutes; |
| |
4| 4. "Military readiness" means a graduating senior who: |
| |
5| a. achieves a passing score set by the applicable |
| |
6| military branch on the Armed Services Vocational |
| |
7| Aptitude Battery, or |
| |
8| b. is accepted for enlistment in the United States Armed |
| |
9| Forces |
| |
10|during a time period established by the Superintendent of Public |
| |
11|Instruction; and |
| |
12| 5. "Not educationally disadvantaged" means a student who does |
| |
13|not qualify for free- or reduced-price meals under the National |
| |
14|School Lunch Act. |
| |
15| C. Beginning with the 2025-2026 school year and each school |
| |
16|year thereafter, the Superintendent of Public Instruction shall |
| |
17|determine and inform each school district, charter school, and |
| |
18|virtual charter school of the number of graduating seniors who met |
| |
19|the career readiness, college readiness, and military readiness |
| |
20|standards defined in subsection B of this section for each of the |
| |
21|following cohorts for each school site for the preceding school |
| |
22|year: |
| |
23| 1. Annual graduates who are economically disadvantaged; |
| |
24| 2. Annual graduates who are not economically disadvantaged. |

1| D. 1. Beginning with the 2025-2026 school year and each school |
| |
2|year thereafter, the Superintendent of Public Instruction shall |
| |
3|determine and inform each school district, charter school, and |
| |
4|virtual charter school the minimum number of annual graduates in |
| |
5|each of the cohorts identified in subsection C of this section who |
| |
6|must demonstrate career readiness, college readiness, and military |
| |
7|readiness in order for the school district, charter school, or |
| |
8|virtual charter school to be eligible for a Rewarding Student |
| |
9|Outcomes Act bonus. |
| |
10| 2. To qualify for a Rewarding Student Outcomes Act bonus, the |
| |
11|school district, charter school, or virtual charter school shall |
| |
12|have at least a one percent (1%) increase in the number of annual |
| |
13|graduates in a cohort identified in subsection C of this section who |
| |
14|demonstrate career readiness, college readiness, or military |
| |
15|readiness above the number of graduates for the preceding school |
| |
16|year. A qualifying school district, charter school, and virtual |
| |
17|charter school shall be eligible for a Rewarding Student Outcomes |
| |
18|Act bonus in the following amounts: |
| |
19| a. One Thousand Five Hundred Dollars ($1,500.00) per |
| |
20| graduate if the annual graduate is economically |
| |
21| disadvantaged, and |
| |
22| b. Five Hundred Dollars ($500.00) per graduate if the |
| |
23| annual graduate is not economically disadvantaged. |

1| SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.545, is |
| |
2|amended to read as follows: |
| |
3| Section 1210.545. A. Except as otherwise provided, as part of |
| |
4|the accountability system developed as provided for in Section |
| |
5|1210.541 of this title, the State Board of Education shall prepare |
| |
6|annual reports of the results of the Oklahoma School Testing Program |
| |
7|which describe student achievement in the state, and each school |
| |
8|site, pursuant to the Elementary and Secondary Education Act of 1965 |
| |
9|(ESEA) as reauthorized by P.L. No. 114-95, also known as the Every |
| |
10|Student Succeeds Act (ESSA), and any related federal regulations. |
| |
11| B. The annual report as required pursuant to subsection A of |
| |
12|this section shall identify school sites as having one of the |
| |
13|following grades for each indicator, separately, and by a single |
| |
14|overview grade of all indicators, defined according to rules of the |
| |
15|State Board of Education: |
| |
16| 1. "A" means schools making excellent progress; |
| |
17| 2. "B" means schools making above average progress; |
| |
18| 3. "C" means schools making satisfactory progress; |
| |
19| 4. "D" means schools making less than satisfactory progress; |
| |
20|and |
| |
21| 5. "F" means schools failing to make adequate progress. |
| |
22| C. Each school that has students who are tested and included in |
| |
23|the school grading system as provided for in this section shall |
| |
24|receive a school grade, except as follows: |

1| 1. A school shall not receive a school grade if the number of |
| |
2|students tested and included in the school grading system is less |
| |
3|than the minimum sample size necessary for statistical reliability |
| |
4|and prevention of the unlawful release of personally identifiable |
| |
5|student data. The State Board of Education is directed to establish |
| |
6|the lowest minimum sample size necessary to meet the requirements of |
| |
7|this paragraph; and |
| |
8| 2. The academic performance of students who are enrolled |
| |
9|full-time in an online program that is offered by a school district |
| |
10|or charter school that is not the district of residence or is not |
| |
11|located in the district of residence of the student shall be |
| |
12|reported separately by the school district or charter school and |
| |
13|shall not be included when determining the grade of the school site |
| |
14|or charter school. |
| |
15| D. The State Board of Education may adopt alternate systems of |
| |
16|accountability for statewide virtual charter schools, alternative |
| |
17|education programs as defined in Section 1210.568 of this title, and |
| |
18|schools serving only grades prekindergarten or kindergarten through |
| |
19|two. |
| |
20| E. The grade of a school shall be based on a multimeasures |
| |
21|approach to accountability in accordance with the Elementary and |
| |
22|Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No. |
| |
23|114-95, also known as the Every Student Succeeds Act (ESSA) and any |
| |
24| |
| |

1|federal regulations that include, but are not limited to, the |
| |
2|following indicators: |
| |
3| 1. Statewide assessments, including the establishment of |
| |
4|student performance bands; |
| |
5| 2. Graduation rates for high schools; |
| |
6| 3. Statewide academic measures for elementary and middle |
| |
7|schools; |
| |
8| 4. English language proficiency for English learners; and |
| |
9| 5. At least one additional statewide measure of school quality |
| |
10|or student success, including, but not limited to, school climate, |
| |
11|school safety, student engagement, educator engagement, and/or |
| |
12|advanced coursework and postsecondary readiness. |
| |
13| F. Of the indicators included in subsection E of this section, |
| |
14|not less than seventy percent (70%) of the overview grade must shall |
| |
15|be given to indicators 1, 2, 3, and 4 and, in the aggregate, with |
| |
16|not more than thirty percent (30%) of the grade given to indicator |
| |
17|5. |
| |
18| G. Further, the grade of an elementary or middle school site |
| |
19|shall include, but not be limited to, a measure of status for |
| |
20|English language arts (ELA), math and science, growth in ELA and |
| |
21|math, English Language Proficiency Assessment (ELPA) progress, and |
| |
22|chronic absenteeism climate surveys administered to students, school |
| |
23|staff, and parents and legal guardians of students enrolled in the |
| |
24|school site. |

1| H. The grade of a high school site shall include, but not be |
| |
2|limited to, a measure of status for English language arts (ELA) ELA, |
| |
3|math and science status, English Language Proficiency Assessment |
| |
4|(ELPA) ELPA progress, graduation rate, chronic absenteeism, and |
| |
5|postsecondary opportunities, and climate surveys administered to |
| |
6|students, school staff, and parents and legal guardians of students |
| |
7|enrolled in the school site. For purposes of this section |
| |
8|postsecondary opportunities shall include Advanced Placement, |
| |
9|International Baccalaureate, dual and concurrent enrollment, |
| |
10|internships, mentorships and apprenticeships, and industry |
| |
11|certifications be based on the percentage of high school students |
| |
12|who meet at least one of the following criteria: |
| |
13| 1. Achieving a benchmark score on the ACT or SAT; |
| |
14| 2. Scoring a 3, 4, or 5 on an Advanced Placement examination; |
| |
15| 3. Scoring a 4, 5, 6, or 7 on an International Baccalaureate |
| |
16|examination; |
| |
17| 4. Scoring the silver level or above on the ACT WorkKeys |
| |
18|assessment; |
| |
19| 5. Earning transcripted college credit while still in high |
| |
20|school through concurrent or dual enrollment; |
| |
21| 6. Earning an industry credential; or |
| |
22| 7. Being accepted for enlistment into the United States Armed |
| |
23|Forces. |

1| The Board shall adopt a time line for moving from completion of |
| |
2|such opportunities to crediting achievement of such opportunities. |
| |
3| I. The annual report shall identify the performance of each |
| |
4|school as having improved, remained the same, or declined. This |
| |
5|school improvement rating shall be based on a comparison of the |
| |
6|student and school performance data of the current year to the |
| |
7|previous year data. |
| |
8| J. The State Department of Education shall annually develop a |
| |
9|school site report card to be delivered to parents or legal |
| |
10|guardians throughout each school district. The report card shall be |
| |
11|in accordance with the requirements of the Elementary and Secondary |
| |
12|Education Act of 1965 (ESEA), as reauthorized and amended by P.L. |
| |
13|No. 114-95, also known as the Every Student Succeeds Act (ESSA) and |
| |
14|includes include the grade for the school, information regarding |
| |
15|school improvement, an explanation of school performance, and |
| |
16|indicators of return on investment. The report card for each school |
| |
17|site shall be published annually by the Department on its website, |
| |
18|and every school district shall provide the school site report card |
| |
19|to the parent or legal guardian of each student enrolled in the |
| |
20|school site. In order to provide information regarding school |
| |
21|performance for school report cards issued during the 2016-2017 and |
| |
22|2017-2018 school year years, the Department shall include an |
| |
23|explanation of the changes to the statewide system of student |
| |
24|assessments as required in Section 1210.508 of this title and how |
| |

1|the transition in assessments may impact school performance. The |
| |
2|Department shall issue school report cards using the 2016-2017 |
| |
3|school year assessment data that is available. |
| |
4| K. The Legislature may factor in the performance of schools in |
| |
5|calculating any performance-based funding policy that is provided to |
| |
6|public school districts. |
| |
7| L. The State Board of Education shall promulgate rules to |
| |
8|implement the provisions of this section. |
| |
9| SECTION 3. This act shall become effective November 1, 2023. |
