12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
13| SECTION 1. NEW LAW A new section of law to be codified |
| |
14|in the Oklahoma Statutes as Section 18-202.2 of Title 70, unless |
| |
15|there is created a duplication in numbering, reads as follows: |
| |
16| A. This act shall be known and may be cited as the "Rewarding |
| |
17|Student Outcomes Act". The purpose of the act shall be to create an |
| |
18|outcomes-based college, career, and military readiness incentive |
| |
19|program for school districts, charter schools, and virtual charter |
| |
20|schools in this state. |
| |
21| B. As used in this act: |
| |
22| 1. "College, career, and military readiness" means a graduating |
| |
23|senior who accomplishes any of the following during a time period |
| |
24|established by the State Department of Education: |

1| a. scores the silver level or above on the ACT WorkKeys |
| |
2| assessment, |
| |
3| b. earns an industry credential, |
| |
4| c. achieves a benchmark score on the ACT, SAT, or |
| |
5| another assessment designated by the State Department |
| |
6| of Education, |
| |
7| d. scores a 3, 4, or 5 on an Advanced Placement |
| |
8| examination, |
| |
9| e. scores a 4, 5, 6, or 7 on an International |
| |
10| Baccalaureate examination, |
| |
11| f. earns transcripted college credit while still in high |
| |
12| school through concurrent or dual enrollment, |
| |
13| g. achieves a passing score set by the applicable |
| |
14| military branch on the Armed Services Vocational |
| |
15| Aptitude Battery, or |
| |
16| h. is accepted for enlistment in the United States Armed |
| |
17| Forces; |
| |
18| 2. "Economically disadvantaged" shall have the same meaning as |
| |
19|provided for in Section 18-109.5 of Title 70 of the Oklahoma |
| |
20|Statutes; and |
| |
21| 3. "Not economically disadvantaged" means a student who does |
| |
22|not qualify for free- or reduced-price meals under the National |
| |
23|School Lunch Act. |

1| C. Beginning with the 2025-2026 school year and each school |
| |
2|year thereafter, the State Department of Education shall determine |
| |
3|and inform each school district, charter school, and virtual charter |
| |
4|school of the number of graduating seniors who met the college, |
| |
5|career, and military readiness standards defined in subsection B of |
| |
6|this section for each of the following cohorts for each school site |
| |
7|for the preceding school year: |
| |
8| 1. Annual graduates who are economically disadvantaged; and |
| |
9| 2. Annual graduates who are not economically disadvantaged. |
| |
10| D. 1. Beginning with the 2025-2026 school year and each school |
| |
11|year thereafter, the State Department of Education shall determine |
| |
12|and inform each school district, charter school, and virtual charter |
| |
13|school the minimum number of annual graduates in each of the cohorts |
| |
14|identified in subsection C of this section who must demonstrate |
| |
15|college, career, and military readiness in order for the school |
| |
16|district, charter school, or virtual charter school to be eligible |
| |
17|for a Rewarding Student Outcomes Act bonus. |
| |
18| 2. To qualify for a Rewarding Student Outcomes Act bonus, the |
| |
19|school district, charter school, or virtual charter school shall |
| |
20|have at least a one percent (1%) increase in the number of annual |
| |
21|graduates in a cohort identified in subsection C of this section who |
| |
22|demonstrate college, career, and military readiness above the number |
| |
23|of graduates for the preceding school year. A qualifying school |
| |
24|district, charter school, and virtual charter school shall be |
| |

1|eligible for a Rewarding Student Outcomes Act bonus in the following |
| |
2|amounts: |
| |
3| a. One Thousand Five Hundred Dollars ($1,500.00) per |
| |
4| graduate if the annual graduate is economically |
| |
5| disadvantaged, and |
| |
6| b. Five Hundred Dollars ($500.00) per graduate if the |
| |
7| annual graduate is not economically disadvantaged. |
| |
8| SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.545, is |
| |
9|amended to read as follows: |
| |
10| Section 1210.545. A. Except as otherwise provided, as part of |
| |
11|the accountability system developed as provided for in Section |
| |
12|1210.541 of this title, the State Board of Education shall prepare |
| |
13|annual reports of the results of the Oklahoma School Testing Program |
| |
14|which describe student achievement in the state, and each school |
| |
15|site, pursuant to the Elementary and Secondary Education Act of 1965 |
| |
16|(ESEA) as reauthorized by P.L. No. 114-95, also known as the Every |
| |
17|Student Succeeds Act (ESSA), and any related federal regulations. |
| |
18| B. The annual report as required pursuant to subsection A of |
| |
19|this section shall identify school sites as having one of the |
| |
20|following grades for each indicator, separately, and by a single |
| |
21|overview grade of all indicators, defined according to rules of the |
| |
22|State Board of Education: |
| |
23| 1. "A" means schools making excellent progress; |
| |
24| 2. "B" means schools making above average progress; |
| |

1| 3. "C" means schools making satisfactory progress; |
| |
2| 4. "D" means schools making less than satisfactory progress; |
| |
3|and |
| |
4| 5. "F" means schools failing to make adequate progress. |
| |
5| C. Each school that has students who are tested and included in |
| |
6|the school grading system as provided for in this section shall |
| |
7|receive a school grade, except as follows: |
| |
8| 1. A school shall not receive a school grade if the number of |
| |
9|students tested and included in the school grading system is less |
| |
10|than the minimum sample size necessary for statistical reliability |
| |
11|and prevention of the unlawful release of personally identifiable |
| |
12|student data. The State Board of Education is directed to establish |
| |
13|the lowest minimum sample size necessary to meet the requirements of |
| |
14|this paragraph; and |
| |
15| 2. The academic performance of students who are enrolled |
| |
16|full-time in an online program that is offered by a school district |
| |
17|or charter school that is not the district of residence or is not |
| |
18|located in the district of residence of the student shall be |
| |
19|reported separately by the school district or charter school and |
| |
20|shall not be included when determining the grade of the school site |
| |
21|or charter school. |
| |
22| D. The State Board of Education may adopt alternate systems of |
| |
23|accountability for statewide virtual charter schools, alternative |
| |
24|education programs as defined in Section 1210.568 of this title, and |
| |

1|schools serving only grades prekindergarten or kindergarten through |
| |
2|two. |
| |
3| E. The grade of a school shall be based on a multimeasures |
| |
4|approach to accountability in accordance with the Elementary and |
| |
5|Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No. |
| |
6|114-95, also known as the Every Student Succeeds Act (ESSA) and any |
| |
7|federal regulations that include, but are not limited to, the |
| |
8|following indicators: |
| |
9| 1. Statewide assessments, including the establishment of |
| |
10|student performance bands; |
| |
11| 2. Graduation rates for high schools; |
| |
12| 3. Statewide academic measures for elementary and middle |
| |
13|schools; |
| |
14| 4. English language proficiency for English learners; and |
| |
15| 5. At least one additional statewide measure of school quality |
| |
16|or student success, including, but not limited to, school climate, |
| |
17|school safety, student engagement, educator engagement, and/or |
| |
18|advanced coursework and postsecondary readiness. |
| |
19| F. Of the indicators included in subsection E of this section, |
| |
20|not less than seventy percent (70%) of the overview grade must shall |
| |
21|be given to indicators 1, 2, 3, and 4 and, in the aggregate, with |
| |
22|not more than thirty percent (30%) of the grade given to indicator |
| |
23|5. |

1| G. Further, the grade of an elementary or middle school site |
| |
2|shall include, but not be limited to, a measure of status for |
| |
3|English language arts (ELA), math and science, growth in ELA and |
| |
4|math, English Language Proficiency Assessment (ELPA) progress, and |
| |
5|chronic absenteeism climate surveys administered to students, school |
| |
6|staff, and parents and legal guardians of students enrolled in the |
| |
7|school site. |
| |
8| H. The grade of a high school site shall include, but not be |
| |
9|limited to, a measure of status for English language arts (ELA) ELA, |
| |
10|math and science status, English Language Proficiency Assessment |
| |
11|(ELPA) ELPA progress, graduation rate, chronic absenteeism, and |
| |
12|postsecondary opportunities, and climate surveys administered to |
| |
13|students, school staff, and parents and legal guardians of students |
| |
14|enrolled in the school site. For purposes of this section |
| |
15|postsecondary opportunities shall include Advanced Placement, |
| |
16|International Baccalaureate, dual and concurrent enrollment, |
| |
17|internships, mentorships and apprenticeships, and industry |
| |
18|certifications be based on the percentage of high school students |
| |
19|who meet at least one of the following criteria: |
| |
20| 1. Achieving a benchmark score on the ACT or SAT; |
| |
21| 2. Scoring a 3, 4, or 5 on an Advanced Placement examination; |
| |
22| 3. Scoring a 4, 5, 6, or 7 on an International Baccalaureate |
| |
23|examination; |
| |

1| 4. Scoring the silver level or above on the ACT WorkKeys |
| |
2|assessment; |
| |
3| 5. Earning transcripted college credit while still in high |
| |
4|school through concurrent or dual enrollment; |
| |
5| 6. Earning an industry credential; or |
| |
6| 7. Being accepted for enlistment into the United States Armed |
| |
7|Forces. |
| |
8| The Board shall adopt a time line for moving from completion of |
| |
9|such opportunities to crediting achievement of such opportunities. |
| |
10| I. The annual report shall identify the performance of each |
| |
11|school as having improved, remained the same, or declined. This |
| |
12|school improvement rating shall be based on a comparison of the |
| |
13|student and school performance data of the current year to the |
| |
14|previous year data. |
| |
15| J. The State Department of Education shall annually develop a |
| |
16|school site report card to be delivered to parents or legal |
| |
17|guardians throughout each school district. The report card shall be |
| |
18|in accordance with the requirements of the Elementary and Secondary |
| |
19|Education Act of 1965 (ESEA), as reauthorized and amended by P.L. |
| |
20|No. 114-95, also known as the Every Student Succeeds Act (ESSA) and |
| |
21|includes include the grade for the school, information regarding |
| |
22|school improvement, an explanation of school performance, and |
| |
23|indicators of return on investment. The report card for each school |
| |
24|site shall be published annually by the Department on its website, |
| |

1|and every school district shall provide the school site report card |
| |
2|to the parent or legal guardian of each student enrolled in the |
| |
3|school site. In order to provide information regarding school |
| |
4|performance for school report cards issued during the 2016-2017 and |
| |
5|2017-2018 school year years, the Department shall include an |
| |
6|explanation of the changes to the statewide system of student |
| |
7|assessments as required in Section 1210.508 of this title and how |
| |
8|the transition in assessments may impact school performance. The |
| |
9|Department shall issue school report cards using the 2016-2017 |
| |
10|school year assessment data that is available. |
| |
11| K. The Legislature may factor in the performance of schools in |
| |
12|calculating any performance-based funding policy that is provided to |
| |
13|public school districts. |
| |
14| L. The State Board of Education shall promulgate rules to |
| |
15|implement the provisions of this section. |
| |
16| SECTION 3. This act shall become effective November 1, 2023. |
