1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 710 By: Rosino | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to schools; amending 70 O.S. 2021, | | Section 1210.242, which relates to authority to | 8| administer opiate antagonists; modifying | | applicability of provisions relating to | 9| administration; updating statutory reference; and | | declaring an emergency. | 10| | | | 11| | | | 12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 13| SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.242, is | | | 14|amended to read as follows: | | | 15| Section 1210.242. A. Any school nurse, public health nurse, | | | 16|licensed practitioner of the healing arts, nurse working under | | | 17|contract with a school district or any person designated by the | | | 18|school administration to administer an opiate antagonist in the | | | 19|event of a suspected overdose is authorized, regardless of whether | | | 20|there is a prescription or standing order in place, to administer an | | | 21|opiate antagonist when encountering a student or other individual | | | 22|exhibiting signs of an opiate overdose. | | | 23| B. The administration of a public school may authorize one or | | | 24|more persons employed by the school to receive training offered by | | | Req. 1|the Department of Mental Health and Substance Abuse Services, a law | | | 2|enforcement agency or any other entity in recognizing the signs of | | | 3|an opiate overdose and administering an opiate antagonist. Persons | | | 4|designated to receive this training may include, but are not limited | | | 5|to, the certified and noncertified staff members required to receive | | | 6|annual training in cardiopulmonary resuscitation and the Heimlich | | | 7|maneuver under Section 1210.199 ofTitle 70 of the Oklahoma Statutes| | | 8|this title. If in-person training is not readily available in the | | | 9|area, the person or persons designated under this provision may | | | 10|access opiate antagonist training materials available online through | | | 11|the State Department of Health or another entity. Such training | | | 12|shall include information on how to spot symptoms of an overdose, | | | 13|instruction in basic resuscitation techniques, instruction on proper | | | 14|administration of an opiate antagonist and the importance of calling | | | 15|911 for help. | | | 16| C. In the absence of the person or persons specifically | | | 17|designated and trained to administer an opiate antagonist under the | | | 18|provisions of this section, the administration of a school may | | | 19|authorize any person, regardless of whether there is a prescription | | | 20|or standing order in place, to administer an opiate antagonist to a | | | 21|student or other individual exhibiting signs of an overdose. | | | 22| D. Any person administering an opiate antagonist to a student | | | 23|or other individual at a school site or school-sponsored event in a | | | 24|manner consistent with addressing opiate overdose shall be covered | | | Req. 1|under the Good Samaritan Act. A school and any of its employees or | | | 2|designees shall be immune from civil liability in relation to the | | | 3|administration of an opiate antagonist in the event of a suspected | | | 4|overdose. | | | 5| SECTION 2.
