 7|       An Act relating to state government; requiring a                |
  |       percentage of state contracts to be awarded to                  |
 8|       certain businesses; authorizing the State Purchasing            |
  |       Director to prepare a bid-preference program;                   |
 9|       defining term; providing for codification; and                  |
  |       providing an effective date.                                    |

12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
13|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
14|in the Oklahoma Statutes as Section 85.49 of Title 74, unless there    |
  |                                                                       |
15|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
16|    A.  Beginning on July 1, 2024, five percent (5%) of all state      |
  |                                                                       |
17|contracts shall be awarded to businesses that have been in operation   |
  |                                                                       |
18|for less than five (5) years.                                          |
  |                                                                       |
19|    B.  For competitive bids submitted to the state pursuant to the    |
  |                                                                       |
20|Oklahoma Central Purchasing Act or pursuant to the Public              |
  |                                                                       |
21|Competitive Bidding Act of 1974 by eligible new corporations, the      |
  |                                                                       |
22|State Purchasing Director shall prepare and implement a                |
  |                                                                       |
23|bid-preference program.  The program shall require that, if the        |
  |                                                                       |
24|percentage of such funds expended on eligible new corporations is      |
  |                                                                       |

 1|less than ten percent (10%), a percentage shall be added to the        |
  |                                                                       |
 2|price of the lowest bid and if the eligible new corporation submits    |
  |                                                                       |
 3|a bid that falls below the lowest bid plus the percentage, it shall    |
  |                                                                       |
 4|receive the contract.  As used in this subsection, "eligible new       |
  |                                                                       |
 5|corporation" means a corporation validly licensed as provided in the   |
  |                                                                       |
 6|applicable laws of this state on and after the effective date of       |
  |                                                                       |
 7|this act.                                                              |
  |                                                                       |
 8|    SECTION 2.  This act shall become effective January 1, 2024.       |
  |                                                                       |
