1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 84 By: Dahm | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to traffic control signals; | | prohibiting contracting for use of photo monitoring | 8| devices; defining terms; providing for codification; | | and providing an effective date. | 9| | | | 10| | | | 11|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 12| SECTION 1. NEW LAW A new section of law to be codified | | | 13|in the Oklahoma Statutes as Section 11-226 of Title 47, unless there | | | 14|is created a duplication in numbering, reads as follows: | | | 15| A. No state agency, county, municipality, or political | | | 16|subdivision may contract with any private corporation to provide for | | | 17|the use of any photo monitoring device to detect any traffic control | | | 18|signal violation. | | | 19| B. As used in this section, the term "photo monitoring device" | | | 20|means a stationary, unmanned device used with a lighted traffic | | | 21|control device to detect a traffic control signal violation and | | | 22|captures photographic identification of the vehicle that results in | | | 23|the issuance of a citation against the registrant, rather than the | | | 24|driver, of the vehicle. | | | Req. As used in this section, the term "traffic control signal" | | | 2|means any device, whether manually, electronically, or mechanically | | | 3|operated, by which traffic is alternately directed to stop and | | | 4|proceed. | | | 5| SECTION 2.
