1| STATE OF OKLAHOMA | | | 2| 1st Session of the 60th Legislature (2025) | | | 3|SENATE BILL 874 By: Hall | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to professions and occupations; | | transferring certain administration to Service | 8| Oklahoma by certain date; providing for the | | promulgation of rules; directing the Executive | 9| Director of Service Oklahoma and Secretary of | | Licensing and Regulation to make certain | 10| determination; requiring certain annual performance | | report; allowing for adoption, amendment, or | 11| rejection of certain recommendations; requiring | | certain quarterly report; providing for codification; | 12| and providing an effective date. | | | 13| | | | 14| | | | 15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 16| SECTION 1. NEW LAW A new section of law to be codified | | | 17|in the Oklahoma Statutes as Section 6021 of Title 59, unless there | | | 18|is created a duplication in numbering, reads as follows: | | | 19| A. No later than December 31, 2030, the administration of | | | 20|professional and occupational licensing in this state including, but | | | 21|not limited to, the licensing of health care providers, behavioral | | | 22|health providers, and professional occupations, shall be transferred | | | 23|to Service Oklahoma. | | | 24| B. 1| 1. Remove, abrogate, reduce, or otherwise affect any power or | | | 2|duty of a licensing board to establish or enforce licensure | | | 3|qualifications, examination requirements, or disciplinary standards | | | 4|or procedures, or to exercise any other power or duty of the | | | 5|licensing board as provided by law; or | | | 6| 2. Confer to Service Oklahoma any power or duty of a licensing | | | 7|board provided by law including, but not limited to, those described | | | 8|in paragraph 1 of this section. The sole function of Service | | | 9|Oklahoma under the provisions of this section shall be to administer | | | 10|the issuance of professional and occupational licenses in this | | | 11|state. | | | 12| C. Service Oklahoma and all licensing boards covered under this | | | 13|section may promulgate rules as necessary to implement the | | | 14|provisions of this section. | | | 15| D. 1. The Executive Director of Service Oklahoma and the | | | 16|Secretary of Licensing and Regulation shall determine the order in | | | 17|which professional and occupational licensing services are onboarded | | | 18|to Service Oklahoma. | | | 19| 2. Beginning no later than July 1, 2026, and to be completed no | | | 20|later than December 31, 2030, the boards identified by the Executive | | | 21|Director of Service Oklahoma and the Secretary of Licensing and | | | 22|Regulation shall transition to Service Oklahoma for the application | | | 23|and renewal of professional and occupational licenses. | | | 24| | | | Req. Before the third Tuesday of November of each year, Service | | | 2|Oklahoma shall prepare and submit a detailed annual performance | | | 3|report and recommendation to the Governor, the President Pro Tempore | | | 4|of the Senate, and the Speaker of the House of Representatives. The | | | 5|first report shall be due by November 18, 2025. The report shall | | | 6|include the following: | | | 7| a. information related to the metrics used for assessing | | | 8| customer satisfaction, transaction efficiency, and | | | 9| service reliability, | | | 10| b. analysis of cost-effectiveness and adherence to the | | | 11| approved budget, | | | 12| c. information on identified areas for improvement and a | | | 13| corrective action plan, if necessary, and | | | 14| d. recommendations for expanding or discontinuing | | | 15| professional and occupational licensing services | | | 16| established by this section. | | | 17| 4. Any change in professional and occupational licensing | | | 18|services established by this section, unless rejected or amended as | | | 19|provided by this subsection, shall become effective on July 1 of the | | | 20|following calendar year. | | | 21| 5. If the annual performance report demonstrates that the | | | 22|established performance metrics have been met or exceeded, | | | 23|additional boards, commissions, or agencies identified within the | | | 24|annual report shall transition their professional and occupational | | | Req. 1|licensing services as recommended by Service Oklahoma, effective on | | | 2|July 1 of the following calendar year. | | | 3| 6. If the annual performance report demonstrates that the | | | 4|established performance metrics have not been met, the Legislature | | | 5|or the Governor may amend or reject the recommendations contained | | | 6|therein. Any amendment passed by a majority vote of each house of | | | 7|the Legislature shall become effective as provided by the amendment | | | 8|unless vetoed by the Governor. | | | 9| E. Beginning January 1, 2027, Service Oklahoma shall publish | | | 10|and make available publicly a quarterly report summarizing the | | | 11|applicable performance metrics, customer feedback, and progress | | | 12|toward achieving benchmarks established by the Executive Director of | | | 13|Service Oklahoma and the Secretary of Licensing and Regulation. | | | 14| SECTION 2.
