6| An Act relating to substance abuse services; amending |
| Section 1, Chapter 311, O.S.L. 2023 (43A O.S. Supp. |
7| 2024, Section 2-401.1), which relates to emergency |
| opioid antagonists; requiring the Department of |
8| Mental Health and Substance Abuse Services to provide |
| emergency opioid antagonists and certain training to |
9| specified school personnel and boards of education |
| under specified conditions; amending 70 O.S. 2021, |
10| Section 1210.242, as amended by Section 1, Chapter |
| 219, O.S.L. 2023 (70 O.S. Supp. 2024, Section |
11| 1210.242), which relates to schools; making certain |
| training mandatory; requiring boards of education of |
12| public school districts to provide certain personnel |
| with emergency opioid antagonists under specified |
13| condition; updating statutory references; providing |
| an effective date; and declaring an emergency. |

16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |
| |
17| SECTION 1. AMENDATORY Section 1, Chapter 311, O.S.L. |
| |
18|2023 (43A O.S. Supp. 2024, Section 2-401.1), is amended to read as |
| |
19|follows: |
| |
20| Section 2-401.1. A. As used in this section, "emergency opioid |
| |
21|antagonist" means a drug including but not limited to naloxone that |
| |
22|blocks the effects of opioids and that is approved by the United |
| |
23|States Food and Drug Administration for the treatment of an opioid |
| |
24|overdose. |

1| B. Subject to allocation of federal funding for the purchase of |
| |
2|emergency opioid antagonists, the Department of Mental Health and |
| |
3|Substance Abuse Services shall provide emergency opioid antagonists |
| |
4|to the: |
| |
5| 1. The Department of Corrections and to county jails for the |
| |
6|purpose of implementing Section 2 of this act 4.1 of Title 57 of the |
| |
7|Oklahoma Statutes; and |
| |
8| 2. Boards of education of public school districts for the |
| |
9|purpose of implementing Section 1210.242 of Title 70 of the Oklahoma |
| |
10|Statutes. |
| |
11| C. The Department of Mental Health and Substance Abuse Services |
| |
12|shall prepare and provide an opioid overdose education program to |
| |
13|the: |
| |
14| 1. The Department of Corrections and to county jails for the |
| |
15|purpose of implementing Section 2 of this act 4.1 of Title 57 of the |
| |
16|Oklahoma Statutes; and |
| |
17| 2. School personnel authorized to administer an emergency |
| |
18|opioid antagonist under Section 1210.242 of Title 70 of the Oklahoma |
| |
19|Statutes at the request of the board of education of the public |
| |
20|school district. |
| |
21| D. The education program shall: |
| |
22| 1. Conform to guidelines of the Substance Abuse and Mental |
| |
23|Health Services Administration for opioid overdose education; |
| |
24| 2. Explain the causes of an opioid overdose; |

1| 3. Instruct when and how to administer in accordance with |
| |
2|medical best practices: |
| |
3| a. life-saving rescue techniques, and |
| |
4| b. an emergency opioid antagonist; |
| |
5| 4. Explain how to contact appropriate emergency medical |
| |
6|services; and |
| |
7| 5. Provide information on how to access emergency opioid |
| |
8|antagonists. |
| |
9| SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.242, as |
| |
10|amended by Section 1, Chapter 219, O.S.L. 2023 (70 O.S. Supp. 2024, |
| |
11|Section 1210.242), is amended to read as follows: |
| |
12| Section 1210.242. A. Any school nurse, public health nurse, |
| |
13|licensed practitioner of the healing arts, nurse working under |
| |
14|contract with a school district or any person designated by the |
| |
15|school administration to administer an emergency opioid antagonist |
| |
16|in the event of a suspected overdose is authorized, regardless of |
| |
17|whether there is a prescription or standing order in place, to |
| |
18|administer an emergency opioid antagonist when encountering a |
| |
19|student or other individual exhibiting signs of an opioid overdose. |
| |
20| B. The administration of a public school may authorize one or |
| |
21|more persons Persons employed by the school to who are authorized to |
| |
22|administer emergency opioid antagonists under this section shall |
| |
23|receive training offered by the Department of Mental Health and |
| |
24|Substance Abuse Services, a law enforcement agency or any other |
| |

1|entity in recognizing the signs of an opioid overdose and |
| |
2|administering an emergency opioid antagonist. Persons designated to |
| |
3|receive this training may include, but are not limited to, the |
| |
4|certified and noncertified staff members required to receive annual |
| |
5|training in cardiopulmonary resuscitation and the Heimlich maneuver |
| |
6|under Section 1210.199 of this title. If in-person training is not |
| |
7|readily available in the area, the person or persons designated |
| |
8|under this provision may access emergency opioid antagonist training |
| |
9|materials available online through the State Department of Health or |
| |
10|another entity. Such training shall include information on how to |
| |
11|spot symptoms of an overdose, instruction in basic resuscitation |
| |
12|techniques, instruction on proper administration of an emergency |
| |
13|opioid antagonist and the importance of calling 911 for help. |
| |
14| C. In the absence of the person or persons specifically |
| |
15|designated and trained to administer an emergency opioid antagonist |
| |
16|under the provisions of this section, the administration of a school |
| |
17|may authorize any person, regardless of whether there is a |
| |
18|prescription or standing order in place, to administer an emergency |
| |
19|opioid antagonist to a student or other individual exhibiting signs |
| |
20|of an overdose. |
| |
21| D. Any person administering an emergency opioid antagonist to a |
| |
22|student or other individual at a school site or school-sponsored |
| |
23|event in a manner consistent with addressing opioid overdose shall |
| |
24|be covered under the Good Samaritan Act. A school and any of its |
| |

1|employees or designees shall be immune from civil liability in |
| |
2|relation to the administration of an emergency opioid antagonist in |
| |
3|the event of a suspected overdose. |
| |
4| E. Subject to the provision of emergency opioid antagonists by |
| |
5|the Department of Mental Health and Substance Abuse Services under |
| |
6|Section 2-401.1 of Title 43A of the Oklahoma Statutes, the board of |
| |
7|education of a public school district shall provide school personnel |
| |
8|authorized to administer an emergency opioid antagonist under this |
| |
9|section with doses of emergency opioid antagonists to carry on their |
| |
10|person or keep in their classrooms or workspaces in the event of an |
| |
11|overdose. |
| |
12| F. As used in this section, "emergency opioid antagonist" means |
| |
13|a drug including but not limited to naloxone that blocks the effects |
| |
14|of opioids and that is approved by the United States Food and Drug |
| |
15|Administration for the treatment of an opioid overdose. |
| |
16| SECTION 3. This act shall become effective July 1, 2025. |
| |
17| SECTION 4. It being immediately necessary for the preservation |
| |
18|of the public peace, health or safety, an emergency is hereby |
| |
19|declared to exist, by reason whereof this act shall take effect and |
| |
20|be in full force from and after its passage and approval. |
