1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 93 By: Rader | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to schools; requiring students | | beginning in certain school year to complete certain | 8| form in order to graduate from a public high school; | | providing exceptions; directing the State Department | 9| of Education to develop and publish certain materials | | and form; directing school district superintendents | 10| to designate certain employee to collect certain | | information; requiring collection of information to | 11| comply with certain act; providing for promulgation | | of rules; providing for codification; providing an | 12| effective date; and declaring an emergency. | | | 13| | | | 14| | | | 15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 16| SECTION 1. NEW LAW A new section of law to be codified | | | 17|in the Oklahoma Statutes as Section 1210.508-6 of Title 70, unless | | | 18|there is created a duplication in numbering, reads as follows: | | | 19| A. Except as provided for in subsection B of this section, | | | 20|beginning with the 2024-2025 school year, in order to graduate from | | | 21|a public high school accredited by the State Board of Education, | | | 22|students shall complete and submit a Free Application for Federal | | | 23|Student Aid (FAFSA). | | | 24| | | | Req. 1| B. A student shall not be required to comply with the | | | 2|provisions of subsection A of this section if: | | | 3| 1. The student's parent or legal guardian submits a signed form | | | 4|authorizing the student to opt out of the requirement of subsection | | | 5|A of this section; | | | 6| 2. A student age eighteen (18) or older submits a signed form | | | 7|authorizing him or her to opt out of the requirement of subsection A | | | 8|of this section; or | | | 9| 3. A school counselor authorizes a student to opt out of the | | | 10|requirement of subsection A of this section. | | | 11| C. The State Department of Education shall develop and publish: | | | 12| 1. Materials for students, parents, and legal guardians | | | 13|explaining the requirements to complete the FAFSA, the benefits to | | | 14|completing the FAFSA, and the opt-out provisions described in | | | 15|subsection B of this section; and | | | 16| 2. An opt-out form to be used by school districts, charter | | | 17|schools, and virtual charter schools for the purposes outlined in | | | 18|subsection B of this section. | | | 19| D. The superintendent of each school district in this state | | | 20|shall designate a school employee to collect information regarding | | | 21|student compliance with subsection A or B of this section. The | | | 22|collection and storage of the information shall comply with the | | | 23|Family Educational Rights and Privacy Act of 1974 (FERPA). | | | 24| | | | Req. The State Board of Education shall promulgate rules to | | | 2|implement the provisions of this section, which shall address the | | | 3|method by which a student is to provide proof to a school district, | | | 4|public charter school, or virtual charter school that the student | | | 5|has completed and submitted the FAFSA as required by subsection A of | | | 6|this section. | | | 7| SECTION 2. This act shall become effective July 1, 2023. | | | 8| SECTION 3.
