1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE BILL 9 By: Bullard | | | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| An Act relating to school districts; directing school | | districts to submit annually to the State Department | 8| of Education certain expenditure report relating to | | diversity, inclusion, equity, or social justice; | 9| directing the Department to make the report available | | on certain website; providing for contents of report; | 10| requiring school districts to submit certain | | additional information to the Department; providing | 11| for promulgation of rules; authorizing certain | | designation of a school for certain noncompliance; | 12| providing for codification; providing an effective | | date; and declaring an emergency. | 13| | | | 14| | | | 15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | 16| SECTION 1. NEW LAW A new section of law to be codified | | | 17|in the Oklahoma Statutes as Section 5-201 of Title 70, unless there | | | 18|is created a duplication in numbering, reads as follows: | | | 19| A. Each school district shall submit to the State Department of | | | 20|Education by July 1, 2024, and each July 1 thereafter an itemized | | | 21|report of school district expenditures for the previous fiscal year | | | 22|related to addressing or improving diversity, inclusion, equity, or | | | 23|social justice in the school district. The State Department of | | | 24|Education shall make the expenditure report available on its | | | Req. No. 38 Page 1 ___________________________________________________________________________

The report required by subsection A of this section shall | | | 4|include the following expenditures for each fiscal year: | | | 5| 1. The number of employees whose partial or primary job | | | 6|function is dedicated to involvement in anti-discrimination, equity, | | | 7|inclusion, diversity, anti-racism, or social justice within the | | | 8|school district. The information shall include the salaries of the | | | 9|employees, the job descriptions of the employees, the number of | | | 10|professional development or training programs performed by the | | | 11|employees, and the number of investigations conducted by the | | | 12|employees; | | | 13| 2. The total amount and itemized expenditures the school | | | 14|district has spent by activity related to anti-discrimination, | | | 15|equity, inclusion, diversity, anti-racism, or social justice; | | | 16| 3. The total number and related expenditures for mandatory and | | | 17|voluntary school staff training, professional development, or | | | 18|rehabilitative sessions provided relating to anti-discrimination, | | | 19|equity, inclusion, diversity, anti-racism, or social justice; | | | 20| 4. The total number and itemized expenditures for mandatory and | | | 21|voluntary student training sessions, seminars, courses, or classes | | | 22|provided relating to anti-discrimination, equity, inclusion, | | | 23|diversity, anti-racism, or social justice; | | | 24| | | | Req. The number of employees subjected to counseling, discipline, | | | 2|or any other remedial measure for violating the school district's | | | 3|anti-discrimination, equity, inclusion, diversity, anti-racism, or | | | 4|social justice policy and itemized expenditures disaggregated by | | | 5|type of measure including but not limited to mandatory or voluntary | | | 6|counseling, discipline, suspension, demotion, or other remedial | | | 7|measure; and | | | 8| 6. The number of students subjected to counseling, discipline, | | | 9|or any other remedial measure for violating the school district's | | | 10|anti-discrimination, equity, inclusion, diversity, anti-racism, or | | | 11|social justice policy and itemized expenditures disaggregated by | | | 12|type of measure including but not limited to mandatory or voluntary | | | 13|counseling, discipline, in-school suspension, out-of-school | | | 14|suspension, detention, or other remedial measure. | | | 15| C. In addition to the expenditure report required by subsection | | | 16|A of this section, each school district shall submit to the State | | | 17|Department of Education the following: | | | 18| 1. A copy of the school district's anti-discrimination, equity, | | | 19|inclusion, diversity, anti-racism, or social justice policy adopted | | | 20|by the school district board of education; | | | 21| 2. Copies of all coursework, homework assignments, classroom | | | 22|presentations, and other materials that were assigned or shown to | | | 23|students as part of a school district's anti-discrimination, equity, | | | 24|inclusion, diversity, anti-racism, or social justice policy; | | | Req. A copy of the school district's student and employee | | | 2|handbooks with the following provisions highlighted if included: | | | 3| a. provisions enforcing the district's | | | 4| anti-discrimination, equity, inclusion, diversity, | | | 5| anti-racism, or social justice policy, | | | 6| b. the penalties or discipline that will be imposed on | | | 7| students and staff for failing to comply with the | | | 8| district's anti-discrimination, equity, inclusion, | | | 9| diversity, anti-racism, or social justice policy, | | | 10| c. provisions explaining the First Amendment rights of | | | 11| students and employees, and | | | 12| d. the due process procedures for disciplining students | | | 13| and employees for violations of the district's | | | 14| anti-discrimination, equity, inclusion, diversity, | | | 15| anti-racism, or social justice policy; | | | 16| 4. A copy of any contract entered into by the school district | | | 17|to provide professional development, training, or any related | | | 18|coursework to employees or students relating to the district's | | | 19|anti-discrimination, equity, inclusion, diversity, anti-racism, or | | | 20|social justice policy including the amount of the contract; and | | | 21| 5. A copy of any contract entered into by the school district | | | 22|for the performance of a diversity analysis or equity assessment or | | | 23|for the development of an anti-discrimination, equity, inclusion, | | | 24| | | | Req. 1|diversity, anti-racism, or social justice policy. The submission | | | 2|required by this paragraph shall include: | | | 3| a. a copy of any bid or proposal received by the | | | 4| district for the purposes set forth in this paragraph, | | | 5| b. a copy of any report or work product generated as a | | | 6| result of a contract for the purposes set forth in | | | 7| this paragraph, and | | | 8| c. the amount the school district expended on each | | | 9| contract for the purposes set forth in this paragraph. | | | 10| D. The State Board of Education shall adopt rules for | | | 11|monitoring compliance with the provisions of this section and is | | | 12|authorized to report a school as deficient on the accreditation | | | 13|report for noncompliance. | | | 14| SECTION 2. This act shall become effective July 1, 2023. | | | 15| SECTION 3.
