1| STATE OF OKLAHOMA | | | 2| 1st Session of the 59th Legislature (2023) | | | 3|SENATE JOINT | |RESOLUTION 4 By: Hicks | 4| | | | 5| | | | 6| AS INTRODUCED | | | 7| A Joint Resolution directing the Secretary of State | | to refer to the people for their approval or | 8| rejection a proposed amendment to Section 23 of | | Article V of the Oklahoma Constitution; allowing a | 9| member of the Legislature to be employed as a | | certified teacher with a public school district in | 10| this state after completion of certain term; making | | language gender neutral; providing ballot title; and | 11| directing filing. | | | 12| | | | 13|BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE | | | 14|1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE: | | | 15| SECTION 1. The Secretary of State shall refer to the people for | | | 16|their approval or rejection, as and in the manner provided by law, | | | 17|the following proposed amendment to Section 23 of Article V of the | | | 18|Oklahoma Constitution to read as follows: | | | 19| Section 23.NoA. Except as provided for in subsection B of | | | 20|this section, no member of the Legislature shall, during the term | | | 21|for which he or she was elected, be appointed or elected to any | | | 22|office or commission in the State, which shall have been created, or | | | 23|the emoluments of which shall have been increased, during his or her | | | 24|term of office, nor shall any member receive any appointment from | | | Req. 1|the Governor, the Governor and Senate, or from the Legislature, | | | 2|during the term for which he or she shall have been elected, nor | | | 3|shall any member, during the term for which he or she shall have | | | 4|been elected, or within two years thereafter, be interested, | | | 5|directly or indirectly, in any contract with the State, or any | | | 6|county or other subdivision thereof, authorized by law passed during | | | 7|the term for which he or she shall have been elected. | | | 8| B. The provisions of this section shall not operate to prohibit | | | 9|a member of the Legislature from being employed as a certified | | | 10|teacher by a public school district in this state after completing | | | 11|the term to which he or she was elected. | | | 12| SECTION 2. The Ballot Title for the proposed Constitutional | | | 13|amendment as set forth in SECTION 1 of this resolution shall be in | | | 14|the following form: | | | 15| BALLOT TITLE | | | 16|Legislative Referendum No. ____ State Question No. ____ | | | 17|THE GIST OF THE PROPOSITION IS AS FOLLOWS: | | | 18| This measure amends Section 23 of Article 5 of the Oklahoma | | | 19| Constitution.
