The bill sets the fine for a violation of the act at $5,000.

It establishes legislative intent. The bill defines applicable terms. The bill establishes procedures for bringing a claim for elder neglect, exploitation, or abuse. The bill permits the district court in which a claim authorized in this act is filed to, upon proper application, issue a restraining order or other injunctive relief to prohibit any further violation of this act, regardless of the existence of any other remedy at law and in addition thereto. It provides, subject to a specific court order, the physician-patient privilege nor spousal privilege will be grounds for excluding evidence regarding the neglect, exploitation, or abuse of a vulnerable adult or the cause thereof in any judicial proceeding arising under the act.

Bill Coleman, R-Ponca City, requires Service Oklahoma to permit a driver license or state identification card holder to voluntarily designate on the holder's driver license or identification card that the person has been diagnosed with an autism spectrum disorder by a licensed primary care physician, licensed psychologist, or licensed psychiatrist. It requires the designation to be used by a law enforcement officer or an emergency medical professional to identify and effectively communicate with a person who has been diagnosed with an autism spectrum disorder and shall not be used for any other purpose by any other person. It requires Service Oklahoma to establish and maintain an automated statewide registry accessible by law enforcement officers for the purposes of identifying and effectively communicating with a person who has been diagnosed with an autism spectrum disorder by a licensed primary care physician, licensed psychologist, or licensed psychiatrist. It requires Service Oklahoma to develop a standardized autism diagnosis form that provides a diagnosing or treating licensed primary care physician, licensed psychologist, or a licensed psychiatrist to certify that an individual has been diagnosed with autism spectrum disorder. The Department of Public Safety, in consultation with Service Oklahoma, the Council on Law Enforcement Education and Training, and the Oklahoma Department of Mental Health and Substance Abuse Services, shall develop a program to assist and train law enforcement officers to identify and effectively communicate with a person who has been diagnosed with an autism spectrum disorder by a licensed primary care physician, licensed psychologist, or licensed psychiatrist. Paraphrase: SB1419, by Sen. Paul Rosino, R-Oklahoma City and Rep. Jeff Boatman, R-Tulsa, directs the Oklahoma Health Care Authority (OHCA) to establish a program under which a family member of a Medicaid enrollee may be certified as an Advanced Unlicensed Assistant by the Oklahoma Board of Nursing and, after receiving such certification may, under the direction and supervision of a Registered Nurse or Licensed Practical Nurse, provide Advanced Unlicensed Assistant services to the enrollee through a licensed home care agency under the reimbursement rates established by statute, provided that the enrollee qualifies for such services under the state Medicaid program. It requires the program require the family member to complete all the training, testing, and other qualification criteria required under state and federal law for certification as an Advanced Unlicensed Assistant in a home setting including, but not limited to, qualification criteria established under the Oklahoma Nursing Practice Act. It requires the skilled tasks performed by an Advanced Unlicensed Assistant in a home setting be subject to the scope of practice established by the Oklahoma Board of Nursing for Advanced Unlicensed Assistants in a home setting. It also requires a Registered Nurse or Licensed Practical Nurse to conduct all home visits required by the Oklahoma Health Care Authority at the enrollee's home. It requires Advanced Unlicensed Assistant services provided by a family member of a Medicaid enrollee who becomes certified as an Advanced Unlicensed Assistant under the program to be reimbursed to a home care agency at a rate established by the Oklahoma Health Care Authority. It requires OHCA and the Oklahoma Board of Nursing to coordinate and share information as necessary to implement the bill. It requires OHCA and the Oklahoma Board of Nursing to promulgate necessary rules. It requires the Administrator of the Authority to apply for such state plan amendments or waivers as may be necessary and to secure federal financial participation for state Medicaid expenditures under the federal Medicaid program. It requires part of the prescribed curricula in a state-approved education program to allow a portion, as determined by the Oklahoma Board of Nursing, of the prescribed curricula for applicants seeking certification to provide Advanced Unlicensed Assistant services in home settings to be completed through training provided by home care agencies or other appropriate entities approved by the board.

Paraphrase: SB1457, by Sen. Greg Treat, R-Oklahoma City and Rep. Chris Kannady, R-Oklahoma City, makes a mental injury illness compensable under workers compensation insurance for a law enforcement officer, paid or volunteer firefighter, or emergency medical technician employed on a full-time basis by a municipality, county, or the, or a voluntary firefighter - collectively known as first responders -- who suffers post-traumatic stress disorder while responding to an emergency. It requires the first responder be entitled to receive compensation which is the greater of the weekly benefit provided for in a collective bargaining agreement or according to the policy of the employer, or 70 percent of the injured employee's average weekly wage not to exceed the state average weekly wage, if the treating physician is of the opinion that the first responder is temporarily unable to perform his or her job or any alternative work offered by the employer. It permits the employer to elect to exercise the temporary pension benefit if the employee has a temporary pension benefit available at no additional cost to the employee and the benefit is equal to or greater than the temporary award in this system. It prohibits disability benefits from extending beyond 52 weeks. It requires a first responder who receives benefits for a mental injury or illness not accompanied by a physical injury who, after reaching maximum medical improvement, is unable to perform the essential functions of his or her employment position and who is not eligible to receive a disability retirement through his or her pension or retirement system to be eligible to be awarded permanent disability benefits not to exceed $50,000. The bill requires, in the event that the Oklahoma Workers' Compensation Commission finds that a first responder has suffered post-traumatic stress disorder not accompanied by a physical injury, that the employer provide reasonable and necessary medical treatment for such injury, subject to the Oklahoma Workers' Compensation Commission's Fee Schedule, for a period not longer than one year. It provides the employer will not be responsible for medical treatment in the form of prescription medicine in excess of $10,000. The bill requires the employer to pay to maintain health insurance coverage for the first responder, if such health insurance was in effect on the date of the injury, during any period in which a first responder is temporarily unable to perform his or her job. It requires claim payments for volunteer firefighters be paid pursuant to the Volunteer Firefighter Group Insurance Pool. The bill defines applicable terms.
