SB1344

Paraphrase: SB1344, by Sen. Paul Rosino, R-Oklahoma City and Rep. Josh West, R-Grove, requires the Department of Mental Health and Substance Abuse Services, the State Department of Health, and the Oklahoma Health Care Authority to collaborate to seek funding opportunities for educational and health care services related to nonopioid alternatives and assist, upon request, political subdivisions that receive opioid grant awards under the Political Subdivisions Opioid Abatement Grants Act with the development and implementation of educational and health care services related to nonopioid alternatives. The bill requires the Oklahoma Health Care Authority, in establishing and maintaining the formulary for the state Medicaid program, to ensure that no nonopioid drug approved by the United States Food and Drug Administration for the treatment or management of pain will be disadvantaged or discouraged by either the authority or a contracted entity with respect to coverage on the formulary relative to any opioid or narcotic drug for the treatment or management of pain. The bill provides that impermissible disadvantaging or discouragement includes, but is not limited to designating any such nonopioid drug as a nonpreferred drug if any opioid or narcotic drug is designated as a preferred drug or establishing more restrictive or more extensive utilization controls including, but not limited to, more restrictive or more extensive prior authorization or step therapy requirements, for nonopioid drug than the least restrictive or extensive utilization controls applicable to any such opioid or narcotic drug. It provides that the bill will apply to a nonopioid drug immediately upon its approval by the United States Food and Drug Administration for the treatment or management of pain, regardless of whether such drug has been reviewed by the authority or the Medicaid Drug Utilization Review Board for inclusion on the formulary. The bill modifies the definition of the terms "approved purpose" and "approved purposes" within the Political Subdivisions Opioid Abatement Grants Act to include providing educational and health care services related to nonopioid treatment alternatives.

The bill modifies the definition of the term "approved purpose" to include any approved uses as authorized by opioid-related settlement agreements in which the State of Oklahoma is a litigant or participant. It modifies the definition of the terms "political subdivision" and "political subdivisions" to include the board of regents or board of trustees of an institution of higher education within The Oklahoma State System of Higher Education. It removes the reference to interest received from the Revive Oklahoma Health Foundation from the definition of the term "Purdue Political Subdivision Fund." It permits the Office of the Attorney General to withhold not more than 5.0 percent of the funds received by the Oklahoma Opioid Abatement Revolving Fund for the staff and administrative support, to the extent allowed by any settlement or judgment relating to opioid litigation involving pharmaceutical supply chain participants. It also permits the funds to be used to research and evaluate the effectiveness of grants disbursed by the Oklahoma Opioid Abatement Board.
