The bill requires the school administrator or attendance officer serve, or cause to be served, upon the parent, guardian, or other person having custody of a child subject to compulsory attendance who is unlawfully absent from school, written notice that the child's attendance at school is required by law when a student accumulates five days of unexcused absences. It requires the school administrator or attendance officer send a new notice after each successive accumulation of five unexcused absences. It requires the director of schools or attendance supervisor implement the first tier of the progressive truancy intervention requirements established in the bill after the child has accumulated five unexcused absences, and after given adequate time, as determined by a school administrator or attendance officer, the child's parent, guardian, or other person having custody of the child has failed to turn in documentation to excuse those absences. It states that it does not prohibit a local board of education from adopting a truancy intervention plan that includes intervention actions to be taken before the actions required by the bill. It requires, on or before November 1, 2025, every school district superintendent devise and recommend a progressive truancy intervention plan for students who violate compulsory attendance requirements prior to the filing of a truancy petition or a criminal prosecution for educational neglect. It requires these interventions be designed to address student conduct related to truancy in the school setting and minimize the need for referrals to district court. It establishes requirements for progressive truancy intervention plans. It permits the district superintendent or attendance officer to report the student's absences to the appropriate judge without first having to implement subsequent tiers if any tier of a progressive truancy intervention plan is unsuccessful with a student and the school can document that the student's parent or guardian is unwilling to cooperate in the truancy intervention plan. The bill permits the district superintendent, after written notice to the parent, guardian, or other person having legal custody of the student, to report the parent or guardian of the student, who is unlawfully absent from school, to the appropriate court in the county or to the Department of Human Services or both if a local education agency (LEA) has applied a progressive truancy intervention plan and interventions under the plan have failed to meaningfully address the student's school attendance. It requires each referral to district court be accompanied by a statement from the student's school, supported by appropriate documentation, certifying that the school applied the progressive truancy intervention plan and the progressive truancy interventions failed to meaningfully address the student's school attendance.

It requires the Oklahoma Department of Mental Health and Substance Abuse Services, in cooperation with the Oklahoma State Department of Education, determine pilot program criteria and establish a process for the consideration of proposals on a statewide competitive basis. It requires the Oklahoma Department of Mental Health and Substance Abuse Services and the State Board of Education each have the authority to require termination of a pilot program or its continuation at any time that it finds such termination to be in the best interests of the students involved. The bill creates the AI School Safety Pilot Programs Revolving Fund.

SB1974, by Sen. Carri Hicks, D-Oklahoma City, allows a school district or the parent or legal guardian of a child to initiate a request for an initial evaluation to determine if he or she is a child with a disability. It requires an initial evaluation to be conducted within 60 days of receiving consent from a parent or legal guardian. It provides that in no event will eligibility for special education and related services cease prior to a child with a disability reaching 22 years of age unless he or she has graduated with a standard or alternate diploma or otherwise completed a secondary education program in accordance with his or her IEP. It requires a school district to provide prior notice to the parent or legal guardian of a child with a disability that includes a description of any evaluation procedures to be used. It requires the State Board of Education to establish and maintain policies and procedures to ensure that children with disabilities and their parents or legal guardians are guaranteed procedural safeguards with respect to the provision of free appropriate public education.
